Hi everyone,

For a bit of background, I am a DACA recipient who recently married a USC and we re currently preparing my AOS package. I came here legally on a B2 visa but overstayed.

Our application has seemed quite straightforward with the unfortunate exception of the I-864 ( ). My USC spouse has been unemployed the past three years due to medical reasons and has received 0 income. Thus, I am including my income in the I-864. It is my understanding that I would not fill out the I-864A as I do not have any dependents.

As I m the intending immigrant and using my income entirely, I m required to provide evidence that my income will continue after immigrating to the US. As I already live in the US, I am attaching a letter from HR which states my current salary, start date, and statement confirming that they will continue to employ me after adjusting status. With this, I m including my tax transcripts for 2021 and 2022 (we are filing jointly for 2023 so already including this), paystubs for past six months, and copies of my EADs showing that this income was earned legally.

So my questions are:

1) Does anyone else have experience using the intending immigrant s income to satisfy the I-864 requirement?

2) My spouse did not file taxes for 2021 and 2022, so those two entries in 24.b and 24.c, respectively, are N/A . We re attaching a statement clarifying that he was unemployed and received no income, thus he did not file those years. But for Part 6 Question 25, does the statement: I was not required to file a Federal Income Tax return apply to ANY of the three most recent tax years, or just if there are NO tax returns to provide at all? It s confusing since my petitioner already checked the box for 23.a. stating that he did not file for each of the three most recent years.

Any advice is greatly appreciated.

We are filing MFJ and are trying to make sure we have everything covered in what is a pretty basic situation. Wondering if we can get any feedback to help us.

ME (USC Living in the US)

w2 wages -

Standard deduction

Her (Resident of mexico NRA)

Has income from MX

Has an investment account

I've made it through but I'm confused. She has foreign income but i'm not sure if we need to include it since she is NRA.

I-130 approved, I-485 denied question

Hello,

I have a friend that applied for AOS & I-130 for his wife in September 2022. He told me that he never heard from USCIS for an entire year until September 2023 when he got an RFE for the I-130.

In November 2023 he sent in what was asked for and got an approval in December 2023 for the I-130. He didn t hear anything else from USCIS so last week he decided to get his senator in Phoenix involved for a status check to see if they have an interview date or not.

Greg Stanton s office ended up finding out that USCIS sent out 2 requests: one letter to appear for biometrics in October 2022 & another letter for a rescheduled biometrics in early 2023. My friend said he never received any letters for biometrics.

Greg Stanton s office also uncovered a I-485 denial letter that my friend said he also never received in June 2023. Besides hiring a lawyer what does he have to do to get this on track? Re-open? Or re-apply for the I-485 and start having his mail sent to a more reliable address?

Hi all,

My wife is a LPR (removal of conditions pending). She and her family are considering buying a plot of land in her home country and she would be contributing a few thousand dollars. This would be the largest share and the plan is to have it in her name. Since she is still a citizen of her home country does this require any legal action on our end in the US? The plan would be to transfer the few thousand to her or her mom s account in her home country and they would use that account for the transaction. I assume this would need to be declared in a potential future interview/citizenship application.

I'll be pursuing a CR-1 spousal visa for my wife and CR-2 for her daughter, which was under 18 at the time of our marriage. I'm looking at submitting the I-130 form for both next week. Would it be beneficial to go ahead and complete the I-485 at the same time, and file them both together? I'm considering the increase in fees that go into effect April 1, 2024. Thoughts?
