Adjustment of status for parents on expired R-1 Visa

Hey! hope everyone is doing well.

I will hopefully became a US citizen really soon and wanted to petition/adjust status for my parents who came to the US with an R1/R2 visa, but expired a couple of years ago. They were in the process of adjusting status through their church but the church main office moved locations and some other issues which I prefer not go into too much detail, but because of this their case was denied last year, and they overstayed their R1 visa.

Does anyone think I will have any issues requesting them?

Hello All and thank you in advance for any guidance/advice.

My husband, at 8 years old, was taken into the U.S. illegally by a family member. Then in 1993 he went to Mexico to get married and came back two days later to the U.S. illegally with the use of a relative's document. Throughout his stay in Texas, the only police problems he had were speeding tickets, sometimes no insurance and sometimes no license. His fines were so high that when he ended up in front of a judge, the judge told him to pay or go to jail. He went to jail for 5 days. After his divorce he left the U.S. on his own, without EVER getting in trouble with immigration officials. I suppose the 10 year ban applies. He left the U.S. in March 2012. My main question is, once I start the consular process for a spouse green card, will he be required to fill a I-601? Is it really up to the discretion of the consular official? I have not turned in the I-130 yet and he resides in Mexico. I figure by the time he is called to meet at the NVC, the 10 years would have passed.

What do ya'll think are the chances that he would be asked for the waiver?

Below is an excerpt from the Feb 2nd, 2021 White House Press Briefing:

Q So the President s third executive order, as I m reading it Restoring Faith in Our Legal Immigration System and Promoting Integration of New Americans should visa applicants in the K1, the student E2 visa programs, should they take this as a sign that they ll be granted travel waivers to return the United States? I know you were asked about that last week.

MS. PSAKI: Yeah, I was, and it is still under review. Obviously, as we talked about a little bit last week or I don t remember if you were here that day. But

MS. PSAKI: But it was a question someone else asked. And married couples, as you know, are able to travel. There was a review of students and of couples who were not married; that review hasn t concluded yet.

What would travel waivers mean in this context?

Also, here's the applicable language from the executive order from Feb 2nd, which should hopefully leads to all immigration processes being sped up.

(b) Within 90 days of the date of this order, the Secretary of State, the Attorney General, and the Secretary of Homeland Security shall each submit a plan to the President describing the steps their respective agencies will take to advance the policy set forth in section 1 of this order.

(c) Within 180 days of submitting the plan described in subsection (b) of this section, the Secretary of State, the Attorney General, and the Secretary of Homeland Security shall each submit a report to the President describing the progress of their respective agencies towards implementing the plan developed pursuant to subsection (b) of this section and recognizing any areas of concern or barriers to implementing the plan.

Public Charge (Medicaid) factor Reentering

Hi all. I am a US citizen and my wife has her PR for over 12 years now.

Our income recently went down and when I went to the healthcare.gov website to for the coverage exchange, they slotted us into the Medicaid category and sent us over to our state (NM) Medicaid agency. Later, after our application went through in December, I learned that there is a new definition "Public charge" rule now including Medicaid and that it could affect my wife's reentry into the US when traveling. We go to Mexico to see her family yearly.

My questions are:

1) Anybody have experience or information on whether this should be an actual problem?

2) Any reason to believe that it will change back to previous definitions anytime soon under the new administration?

3) I believe that I can cancel her off the Medicaid program if need be - but is she already in trouble since she has been signed up? Anyone understand how the timing works? Is it - "if you have been a public charge anytime over the last x years" or is it just "currently"?

4) Anyone know how is USCIS is notified of Medicaid coverage ?

This is the only public charge type of thing we have every " received" and would not have even considered it if the gov website had not sent us there.

Will our dads criminal histories affect the visa approval?

So, my fiance is Mexican and his father was sent to prison for doing some pretty corrupt things as a federal police officer. My own father has restraining orders against him and has been arrested a few times. Can our fathers criminal histories be a "red flag" or used against us when trying to get the visa approved?
