Get attorney for CR1 if US spouse has criminal history?

Hi there,

We are planning to start the process soon with an Iranian spouse that has residency in Italy and an American spouse that has a criminal history (misdemeanor expunged at the state level)


We are wondering if it s worth getting an immigration attorney as our case is fairly unique and different and I know crimes can affect the process a lot. I also have heard that immigration attorneys can be a waste and even mess up the process as well

Would appreciate any input on this?

Greetings,

My expedite request for my I-129F Petition was granted on November 30th by USCIS on behalf of my Senator. It has since been 40 days. I was wondering when the appropriate time is to make an additional inquiry. It should be said I did my first inquiry at the 30-day mark, and am still waiting to hear back about case outcome. Any guess on what the next practical move should be from here?

I've heard of peoples expedites going to purgatory and thats what I'm trying to avoid, but if its a logical step to wait a few more days or weeks I get that.

Effective Dec. 12, 2022, U.S. Citizenship and Immigration Services (USCIS) is updating the USCIS Policy Manual to allow USCIS to automatically extend the validity of Permanent Resident Cards (commonly called Green Cards) for lawful permanent residents who have applied for naturalization.

This update (PDF, 307.54 KB) is expected to help naturalization applicants who experience longer processing times, because they will receive an extension of lawful permanent resident (LPR) status and may not need to file Form I-90, Application to Replace Permanent Resident Card (Green Card). LPRs who properly file Form N-400, Application for Naturalization, may receive this extension without regard to whether they filed Form I-90. USCIS will update the language on Form N-400 receipt notices to extend Green Cards for up to 24 months for these applicants. The receipt notice can be presented with the expired Green Card as evidence of continued status as well as identity and employment authorization under List A of Employment Eligibility Verification (Form I-9), if presented before the expiration of the 24-month extension period provided in the notice.

***This is for 10-year green card holders whose green card is expiring soon they can file an n400 instead of renewing their green cards with a i-90. Not helpful for conditional green card holders because it is the same 2-year extension to the old green card expiration date that i751 applicates gets with the i751 receipt notice.

DS-160 appointment question

We filled out the DS-160, printed and saved the confirmation page and entire application, and now at the MRV fee page where it says there are no appointments available.

Do we randomly check back and pray for an appointment date, or is there something I'm missing?

The welcome letter has outdated links and information, and the embassy website isn't much help at all.

I'm unable to find this answer in the flowchart.
