I-864 Tax records missing

Hello everyone,

first of all thanks for all the help so far. This forum is incredible helpful.

We got our I-130 approved last week, and honestly I did not expect it to go that fast at all (50 days). This is amazing news, but we have a problem with not having my husband's 2020 tax return (petitioner) yet. He applied for an ITIN for me in order to do his taxes in February. After 3 months of waiting we got the answer that they can't process the case, because he was supposed to file his taxes with the application for an ITIN, which wasn't clear to him. So now we need to wait another 10 weeks to get his tax return papers for 2020. We were thinking of several options:

  1. filing the I-864 without 2020 tax return, but with W2 and explanation why he did not include the tax return paper
  2. asking his parents to be joined sponsors
  3. waiting until he gets the tax return (least favorable of course)

Any suggestions on what would be the best way to proceed?

Thanks a lot in advance!

Hello,

I'm confused with different information on how to begin the Immigration Process, in which the first step is Filing the Petition. I currently reside in Germany and will peition my wife (German citizen) to immigrate to the U.S.

We don't have any special circumstances and I'm not in the U.S. military.

The U.S. Department of State provides this advice: https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-1-submit-a-petition/filing-petitions-outside-the-us.html#ExternalPopup

Filing Routine Form I-130 Petitions

Petitioners residing outside of the United States may file Form I-130, Petition for Alien Relative, online at https://www.uscis.gov or by mail to the USCIS Dallas Lockbox at one of the addresses below.

The U.S. Embassy & Consulates in Germany site provides this advice: https://de.usembassy.gov/visas/immigrant-visas/family-based-immigration/immigrant-visa-petitions/

How to file an I-130 petition:

U.S. citizens residing in Germany must file the Form I-130, Petition for Alien Relative, by mail with the USCIS Dallas Lockbox facility. Please visit USCIS website for detail.

So, already, I am confused on what the appropriate start to the process is, do I mail the petition to the Dallas Lockbox or file the petition online? Which process is quicker and easier to track? Has anyone filed their petition recently that is also in a similar situation as myself?

Thank you,

How do I Get Started With Knowing What Documentation is Needed at What Time?

Hello everyone,

I'm a member here and have read a couple of stories of how some of you have started your immigration process, and it is really amazing to see the patience and support from so many of you here.

I have honestly not even started yet, and I don't really have an excuse as to why not. My German wife has given me full authority to investigate and understand all of the necessary documentation I will need and for me to create a timeline of when certain documents are needed to properly filled out.

It all seems overwhelming to me, so I do have notes on my situation. I will be applying for a spouse visa and both my wife and I live in Germany currently and I'm a U.S. citizen. What I am really afraid of, is not having all of the necessary information that I need or that is required.

Can some of you here share with me how you started your planning, some helpful hints or advice when feeling overwhelmed or stuck?

Thanks for all of your stories and sharing!

Best,

Hi,

Any Sacramento Field Office N400 Filers here? They seem to be one of the slowest field offices and I was wondering if others could share their journey to see where we re at.

TIA!
