General Provision or Married to US Citizen? |

I originally obtained my LPR status based on entering on a K1 visa (Fianc ' visa) and subsequently marrying my US citizen husband. This was about 18 years ago. We are still married and live together with our children. It is now time for me to submit form N-400 and I am wondering if I should base this on "General Provision" or "Married to US citizen"? Does it matter? Can I apply under General Provision even though I got my GreenCard based on marriage to a US citizen or would that be wrong to do? I don't want to do anything that would get me in trouble. Thanks.

I'm in the final stages for compiling our package to send off and now I'm down to all of my oddball questions that I haven't found specific instances asking about. 1. For our ongoing relationship proof, I have some call logs of our FaceTime calls, and I can pick through our texts if it's helpful. I also have post cards and letters but the dates aren't legible on them because they were stamped over the stamps in faded ink. Is that an issue? Is this enough to include and are the texts needed? We also have 15 photos we're including spanning our 4 trips together. 2. For proof of travel, I have my passport stamps from my visit. However, the US hasn't stamped her passport the last 3 visits she's been here. We have her I-94 because we started working on this while she was visiting and therefore some documents are dated during her time here and we included her info on the i129f. We also have boarding passes but they're digital. Right now, I've put the digital (expired) boarding passes on a word doc with text stating when they're from underneath. I'm not sure if that's good enough or what more I can do given we don't have paper ones (except one from my return flight that I included copied on the sheet with my passport stamps). 3. For proof we will get married within 90 days -- we have a full wedding planned a year from now, crossing our fingers that we have enough time and won't have to withdraw our petition and start a new one with the CR-1. We originally planned to file the CR-1 so that's why we've booked everything but since the K-1's have sped up in approval, we decided we had nothing to lose to be together sooner. We have vendors booked, venue, and officiant. Do I include these correspondence with the i129f to prove we intend to get married? We both signed letters of intent based on the template on VJ (very simple, just a couple lines) and I have the receipts for her ring, but I have more I can include. I'm just not sure if there's a benefit or if this could somehow hurt us for having so much planned when we don't know exactly when she'll be approved. This is all so stressful and I want to do everything possible to minimize all chances for an RFE, so I'm trying to cover my bases in advance. Thank you!

Hi everyone I am currently getting all the documents ready for my adjustment of status so we will be ready to file them after our wedding in a few weeks. While filling out the forms I was wondering something. When we applied for the marriage certificate, I already wrote on the sheet that I would like to take my fianc 's last name. I read that by doing so I can use my new name right after the wedding and it's legal. But a little voice in my head issues me some headache and I can't ignore it. Can I file the documents with my new name or do I have to file them with my maiden name since my visa (K1) was on my maiden name as well? This might be a weird question but I REALLY don't want to be denied because of this Also, the part "in care of" in the documents address section: if this is my address, can I just leave it empty or should I add N/A? And another one ( ) in my I-485 Document I'm asked for my Given Name (First Name) on my I-94... for some reason, my middle name is, in this I-94 document, a part of my first name (I don't spell them with a hyphen, so the second name is a real middle name) but I always write it into the "Middle name" field... should I write it into the "first name" field this time to be completely correct and write N/A into the "middle name" field although its always not like this? Maybe I'm waaay too much in my head and overthink this but I also don't want to be denied thanks in advance!

Hello everyone, I have already read many forum topics on my subject, but our situation is a bit more specific and I can't find an answer. Before I look for an immigration lawyer, I am trying to find the best order for our plan. My girlfriend was born in the US, so she has both American and German citizenship. However, the family left the country after only 2 years and returned to Germany. Now it is our greatest wish to emigrate to the USA together. We are not married yet, but plan to be. Is it possible for me to apply for a Green Card as a partner after marriage? What options do we have and which one is best for us? I have read a lot about the fact that it could be a problem that my girlfriend has no American income and has not filed any tax returns yet. She would probably have to do this for at least the last three years. I would be grateful for any help.
