NVC Documents Qualified - Sponsor Income question

My NVC documents have finally qualified after a few weeks of waiting! I received a notice saying This case does not meet the minimum income requirement to sponsor the intending immigrants. To avoid delays, an additional Affidavit of Support Form I-864 from a joint sponsor may be submitted. For more information visit https://nvc.state.gov/aos. The consular officer will make a decision regarding this requirement at the time of the interview. For more information, please visit https://www.uscis.gov/i-864p.

I have a few questions about this..

1, The income of the sponsor submitted was above the threshold but the recent tax returns were significantly less, do you think this was the issue?

2, The sponsor has a new job now, do we need to complete new forms and take this with the applicant to the interview?

3, As it recommends a joint sponsor, should we get one and first present the new job/income to the interviewer before adding a joint sponsor and mention we have it just in case we need it?

What would you do in this situation?

Wife Denied Permit Test At CA DMV, SSN Name Not Updated Since Marriage

We are currently waiting for our AOS interview, adjusting from K1 visa. My wife just went to the California DMV and tried to take her written permit test. They turned her away because the name on the social security card is not the same as the name on her marriage certificate. She didn t update her name, after our marriage, with the Social Security Administration. I don t know how we go about doing this. She really needs to drive soon. She has her EAD. If she gets her name updated and has a replacement card ordered, will it still say on that card that she isn t allowed to work now that she has her EAD? I was told by visajourneyers a while ago to wait until we have the green card to request a new card with her updated name so I m very confused. Thanks

N400 Interview Experience - Newark

Hi Everyone,

My journey has finally ended! I applied to n400 last July (NYC, 5 years rule) moved to NJ in October. Had my biometrics re-use letter in March, and just came back from the interview at Newark, where I also did the Oath shortly after.

IO was super friendly and nice, and everyone there extremely helpful and welcoming.

What I took with me:

  1. 5 years of tax returns
  2. Passport (expired)
  3. Select service registration
  4. Marriage certificate and divorce certificate
  5. Green card (the 10 years one) but also the expired one, and the work permit
  6. Proof of home purchase
  7. Electricity bill

What she looked at:

  1. Only most recent tax return
  2. The passports
  3. Didn't care about SS, cause I'm also older than 31
  4. Didn't care about my marriage certificate nor divorce given the 5 years rule, although she did ask my current marital status
  5. Didn't look at the bills/deed.

After she asked me the questions/writing/reading, we went through all of the yes/no questions, and I was approved. She then took my green card, asked for the expired one, and if I had a work permit. All was handed over, and I got the 'you're approved' letter. Waited about an hour, and had the oath with 12 or so more people.

Very painless and super easy. Now onwards to waiting 8-12 weeks for a passport, ha!

Thanks everyone for all the help getting me here. You were all crucial for this success. Hope my experience helps!

Best of luck :)

Interview questions

Our interview is scheduled next month in Detroit. We submitted my husbands AOS packet on December 18th, 2020 which was the 90th day of his ESTA (we didn t plan on it, it just took a long time to get documentation around). His PD is December 22nd 2020. At the time that we filled out the application, we marked NO on Part 8 #17 Have you EVER violated the terms or conditions of your nonimmigrant status because he was still within his 90 days.

Do we need to answer YES instead when we go to the interview since he technically had 4 days of overstay?

Also, now that my husband has his SSN I will be filing our 2020 taxes. Do I need an updated Affidavit of Support for the interview or just bring a copy of the 2020 taxes?

I-290B Motion to Reopen (Denied I-751)

Hello.

Here's the sequence of events:

- I submitted an I-290B with the divorce decree proving the termination of the marriage. I got receipt from USCIS. (this is the most recent event)

- I-751 Case Denied due to missing divorce decree. The letter of denial explained that I could file an I-290B presenting "new facts"

- My divorce was not finalized by the deadline that USCIS gave me, so I responded explaining why there had been delays in my divorce process

- Received the RFE letter

- Went to the Interview by myself, which I thought went good. The USCIS officer told me that she'd issue another RFE for a divorce decree (for the waiver that I opted for). My divorce was not yet finalized though.

- I received an interview notice

- I responded to the RFE

- USCIS issued a Request for Evidence 2 years later

- We separated

- I-751 was filed with my ex-spouse

(Note: I've always 100% followed every procedure and met every deadline. The fact that I didn't have the divorce decree in time for the second RFE was outside my control)

My questions:

1. As of 2021, how long does it take for USCIS to review an I-290B Motion to Reopen?

2. Given the events stated above, is it safe to assume that USCIS will reopen my case?

3. Since I've complied with every request and the interview, is it appropriate to expect approval for my I-751 if and once my case is reopened and USCIS sees the final divorce decree? My understanding is that it is USCIS procedure to have a divorce decree in order to allow an applicant to opt for a Waiver.

Thank you
