US Immigration from Dominican Republic

We sent our k1 application in September 2020 but I (the benefitiary) just got a potential job offer to be sponsored for an American company to work with them. We wonder if the company sent the petition how that would impact or affect our K1 application. Please give me all the information you can.

I'm new to the forum; I have ben trying to find some help at not avail so far.

I'm a L-1A visa holder; my 15-year-old daughter is a L-2 visa holder. We have been in the States for a little over three years now. I recently got married to my wife; we had been together for over a year and engaged for a few months. I have been reading and educating myself about the Adjustment of Status process; I believe I have it down for the most part - all forms and evidence we need but there's something that's confusing/misleading me:

1. I filled form I-485 for my daughter
2. I cannot find anywhere what 'Application Type or Filing Category' (Part 2.) I have to select for her; I only know she's a 'Derivative applicant'
3. On page 23 of the I-485 instructions, 'Additional Instructions for Family-Based Applicant' under the 'Immediate relative of a U.S. citizen (Form I-130, Petition for Alien Relative)' it says: "Derivative applicants are not allowed in this category"

If I'm not mistaken, my daughter is my wife's stepdaughter now. According to what I have read, my daughter qualifies as a child of my wife but given my daughter is a 'Derivative Applicant', my question is, what is the Application Type or Filing Category I should select or enter for her? This is the only thing that's holding us off from submitting the petitions.

After a long and frustrating wait for a response, we have been refused.

A waiver is available, but we are wondering if the services of a lawyer are necessary to prove extreme hardship.

Our reasons for extreme hardship:

-If I were to move to my spouse's country of residence, my salary at MOST would be 25% of what it is currently. And that is optimistic. In reality it would most likely be 10% or less than my current salary. And that is if I could obtain employment at all.

-Living conditions in the region where my husband currently lives are far below my current standard of living (no 24 hour power, no reliable public water supply, embassy advisory of high rate of crime). Relocating within the his country would mean a loss of income for my husband, with no appreciable gain in my income, along with other costs of living increasing.

-Other than my husband, I have no ties to his country. I have lived in the US my entire life, as has my family and extended family.

-My staying in the US, remaining married, and continuing a long distance relationship, would present a financial hardship, as well as intensify my symptoms of depression and anxiety over the situation.

Has anyone self filed?

What kind of questions were asked at your GC interview? Did they separate you and your spouse ?
