Good Evening, It s been 109 days since USCIS has actively been reviewing my I-130 petition to get my wife from Colombia to join me here in the US. Correct me if I am wrong, but isn t the purpose of the I-130 to establish the validity of a bonafide marriage? What else goes into the I-130 process...are they waiting for responses from Bogota, are the waiting for the results of a background check...any thoughts? Her petition was opened in early February 2021...anyone else past 100 days of after USCIS opened their I-130?

I just returned to this site after 12 years as it was a lot of help for me getting my wife through the initial visa and following permanent resident process. Now a dozen years later I am requesting help with her failed naturalization part. She is horrible with tests and had a deaf interviewer with someone translating in sign language to him for her first test!

First, has anybody here failed both chances and then reaplied?

Now I understand that I can re-submit the N-400, another 800 or so bucks and go through the process again and can apply at any time? Correct? Asking here as I can not get anybody other then a computer when calling USCIS!

The next thing is on the denial letter it mentions possibly filing a form N-336 to request a hearing. It almost sounds like that would be a chance to get through it without taking the test? However, there is still an 800 or so dollar processing fee so if they don't approve her at the hearing we would need to pay 800 again to reapply with another N-400 making that decision a risk.

Has anybody done that?

Just looking for ideas as USCIS is useless to contact for a simple question.

Does anybody have a number that can actually reach a person? I know, good luck with that one!

And BTW, she is 45 and doesn't qualify for any special exemptions. Just unlucky. As an example, the second time preparing for the test she was doing well, except for questions regarding the constitution (her main bad part). 3 of the first 4 questions were those questions she just could not answer no matter how many times I went over them with her!

Hello Everyone,

I hope that this message finds you well...I am curious about a couple of things and hopefully some of you who recently, 2021, became US Permanent Residents can help with the following questions:

After US Entry or Arrival on US Immigrant VISA issued by Consulate or Embassy:

1)How long did it take you to receive your green card? (entry Year 2021)

2) Did you select "YES" on the DS-260, if so did you get your SSC? If not, how did you make it work to get one since the SS-Offices are all closed and only taking "emergency" appointments.

I have been reading the forums for the 2020 year (not a surprise) and apparently, it was a such a mess! In my personal experience, even if you chose the DS-260 option, not a single person I know in over two decades gotten theirs that way (I assume some may have gotten theirs that way)... they always had to go in person and apply at their local SS-Office. The green card arrival upon US entry was a big range between 1 week to 2 years. Anyway... any recent experience/advise is appreciated....

Hello all,

So my wife takes her oath to become a US Citizen in 2 weeks. One goal of hers was always bringing her parents here.

My wife's brother, lives in the USA, and is a born US Citizen. He is 19. Both my wife and my wife's brother want to bring their parents to the US.

My wife's brother recently went to a lawyer who told him that my wife should be the petitioner (due to her age being over 21). My wife is a full-time student, has no income.

So the lawyer told my wife's brother that he (the brother) can be the financial sponsor. Since sponsors only need to be 18 years old or older to sign the Affidavit of Support.

So, now we have this situation where my wife, as the petitioner, would require a co-sponsor, her brother. He makes 125% of poverty level for all household members, including the mom + dad. But he doesn't live in the same State as my wife.

The questions become:

1.) My wife and I file "married filing joint" tax returns. She has no income, she is a student. Our income, bank accounts, savings, it's all together in shared accounts. So does that mean MY income, as her husband, is automatically counted and used for these calculations as HER income? Meaning the brother won't even be needed for the co-sponsor? Would USCIS automatically drop him?

2.) If my wife becomes sponsor, and my wife's brother becomes co-sponsor, how am I affected by being the spouse of the sponsor? How are sponsors spouses affected by this legal obligation? Especially since our finances are tied together?

I hope I explained clear enough. The point I am trying to get across is that if my wife and her brother petition and sponsor their parents, I want no legal commitment, I want no financial responsibility, I want nothing to do with it on legal paper. of course I'll help off the record, but I have no interest in being roped into anything. So, I am concerned that because my wife and I technically have a shared income, that I become on the hook for the parents through my wife.

So I know this situation probably requires lawyer advice, and I just literally mentioned my wife's brother talked to a lawyer, but A.) My wife and her brother aren't on speaking terms, so everything is coming second hand through the parents back and forth (stupid I know), and B.) I don't like / don't agree with the lawyers advice to say to my wifes brother that he can be the sponsor. I feel if my wife petitions SHE IS THE SPONSOR, and the brother is a co-sponsor. But again, technically, my wife through me, has the finances, so I don't want her stuck all alone on this.

Thoughts? Advice?

It does not allow me to add financial evidences of petitioner and the Joint Sponsor leaves N / A

 I have a question, I have already added all the documents of the main applicant, I added the joint sponsor but it has been in the N / A status for more than 24 hours and it does not give me the option to add documents of the main sponsor or the joint sponsor, is it normal? should I wait for it to be enabled?
