I am trying to help a friend (they WILL be using an attorney) but I got curious about their situation:

My friend's husband came illegally in 2004. Stayed until 2008 and left. (Never had any issues with the law, immigration no fake paperwork or deportation).

He came back in 2014 with ESTA and overstayed. They are in the beginning stages of applying for his adjustment of status. He will need a waiver because he came back in 2014, before the 10 year ban from the 2008 exit was up?

Overstay Visa will affect K1 visa?

Hi everyone once again,

I m currently abroad visiting my fianc while we wait for her K1 visa. If I overstay my 90 day tourist visa, will that affect her chances of receiving her K1 visa to enter the US? Or is this issue two separate things?

One of my cousin's birth date is 15th January 1994
His Priority Date is 21st may 2010

Approval date November 26, 2014

Case category F4 (his aunty applied for her mother)

now will he be under cspa when visa will be available ?

Hi everyone,

My fianc was sent back to Brazil after entering the country on a tourist visa because they believed she entered with intentions so stay. After this, we applied for the K1 and our case has since been approved by USCIS. Should at some point she submit a I212 form or is this irrelevant?

any help would be appreciated!

Is it risky to leave the US with Advance Parole while waiting for an interview?

I've seen some people freaking out about it and others not concerned about it at all. Any attorneys here to provide more realistic and reliable information about it or some people who had left the US recently?

My husband and I are waiting for USCIS to schedule an interview since early April/20. He came here on an F-1 visa and completed his MBA last year, and he was on a valid OPT at we got married and submitted our application. It was processed very quickly until the last update which is "case is ready to be scheduled for an interview".

He read online a bunch of people saying to not leave the US until getting a GC and this is freaking him out. I told him to not worry about it, although it's easier for me as I'm a US citizen, so I was wondering I would be able to find more realistic and reliable information about this topic.

PS: AOS from an F-1 visa through marriage.
