My child 12 years old living outside of US is coming to visit me for about 30 days in US. (I am US citizen)

I want to apply to his citizenship at the same time that he is here visiting me, but he will not live here at this moment.

Should I have one I-130 and another I-845?

Should I apply in advance or wait him to be here in US?

Another question :) as I understand he will be automatically considered citizen and not a GC right?

I wish I could do all the paperwork here in US as the embassy is far away from where he lives in.

Working & Traveling when 2-year Green Card Expires

Hello,

My wife just got her conditional green card for 2 years after getting her K1. When it expires in 2 years, how will she be able to work and drive legally when it expires and we wait for her 10 year GC?

Looking for some help!

I-751 typographical error, name change

I'm sharing a recent experience with USCIS for others who may be feeling frustrated with the process to correct errors or any similar problem. My husband's I-751 was filed more than a year ago, and when the I-797 was received a couple of weeks later, with the initial 18 month extension, his name on the I-797 was not spelled correctly. It was a minor error, only one letter was wrong, so we figured he could correct it at the biometrics appointment, which happened in August of last year. At biometrics, he corrected the spelling on the form and told the person processing his case. They said they could not make the correction, which seemed strange. It seemed logical to me that the biometrics staff would see the error on the I-797 and biometrics letter, because the green card, passport, I-751, and driver's license are all correct, so why would they not simply make the correction when doing biometrics? The first attempt to fix this error after biometrics was via the online USCIS typographical error feature, which he did and then we waited. Nothing in reply. Months went by. The 24 month extension I-797 arrived and had the same name spelling error. Another typographical error request was submitted online in late April of this year. Again, no response. In late May we sent a letter to the Missouri Service Center, to the address listed on the I-797, requesting the name spelling correction, and included photocopies of both I-797s, the biometrics appointment letter, and green card. He also asked USCIS in the letter to link his I-751 case to his USCIS online account. Because of the spelling error, the I-751 documents and status were not linked to his account, even though the A numbers and date of birth on the I-751 and original CR-1 case were the same. All of this confirms the incompetence of USCIS, which seems to happen to many people. Yesterday, the USCIS case status showed "name was updated" for the I-751 receipt number. Finally something positive! We're hoping to receive a new extension letter soon with the corrected name because we are going to Canada for vacation in two weeks and don't want to have problems returning to the US because of the error. If the I-751 is not linked to his online USCIS account in the next few weeks, he will try to call and speak to a tier two officer. In the meantime, we are hoping for a waiver of the ROC interview based on the new guidance and our very strong ROC package (more than 500 pages of quality evidence). He will file for naturalization in August, at the 3-year mark of his entering the US as an LPR and living together as a married couple. Lesson learned in our case: sending USCIS a formal letter with documentation got a quick response and action while the online typographical error tool did nothing. Good luck everyone with this long, frustrating process!

Questions regarding AOS as a B2

Hi everyone,

I'm currently in the US visiting my (now) fianc e and I have a few questions about adjusting status as a B2 visitor. I know there are a lot of similar posts, but I got a bit anxious and information is never enough! Before that, a little bit of context:

I entered the US on May 2nd to attend to my (then) girlfriend's graduation and help her move from Florida to Pennsylvania for her master's degree. In the meantime, her younger siblings came from Brazil to live with her to go through high school here and finally go to college in 2 years. They're all Americans. Right now we're in Pennsylvania and circumstances have changed: Partner proposed to me and asked me to stay since I'm helping so much with organizing the house and things in general, she knew it would be difficult to take care of two teenagers, but it would be impossible without me at this point. Back in Brazil I still maintain a registered individual business for video post production (which I pay monthly taxes for) and my bank account. I say this not because I intend to work while adjusting (I do not), but as evidence. I don't have a car or a house to my name since I lived with my parents and we shared a car. That is exactly the same information I gave the CPB Agent (except for the engagement which is of course new): I told him I was visiting my girlfriend, he saw my printed email with date and address for the commencement, my business papers and invoice for recent jobs, and my ticket back.
So, to the questions:

  1. It's the most obvious one, but I'd like to get it out of the way: AOS is avaliable in our situation or will they red-flag us for something?
  2. I've read countless people saying that the 90-day rule doesn't exist, but lawyers still say it's a thing to be considered. Should we wait the 90 days or marry whenever we see fit?
  3. We will be needing a sponsor since she didn't make the required income for last year's tax return, but is making now (so I hope that's a win). What additional documents will our sponsor be filling?
  4. About her siblings: they didn't live here last year, so they're not declared as dependents for last year's taxes, but they're of course part of the situation now. Someone said they didn't need to be brought up since the process takes the last taxes into account, but I feel like this is lying by omission and I will not risk our future together for some stupid reason. How are we addressing this situation in our Forms? Is it as simples as increasing the household number?
  5. Our relationship goes back to high school, so besides photos, what other evidences can we produce while I'm here in a visitor visa? (I'm being added to the apartment lease at the moment.)
  6. Is there anything else we should know before going on with the process? Any tips?

Hi, I have a doubt, if someone it's already in a I-130 process, it's possible for this same person apply for an EB3 visa process? The questions is: the same person can be at two different process at same time or as long the person apply for one process this person its not allowed to apply for another visa process, and I would like to know specifically about I-130 and EB3. Thank you in advance.
