K3 failed interview -- Guangzhou Consulate

Timeline

The unbelievable has happened. My wife was denied her K3 visa (for now) at her interview.

First, a little history. We met on-line 7/3/2006 and it was magic. We spoke every day until I first went to China to be with her in September 2006. I returned in November 2006 and we married. I have since returned in January 2007, April 2007, June/July 2007 and November 2007 (for her interview). We bought an apartment under construction in Zhanjiang, China in December 2006 with construction completed in June 2007.

We documented 648 internet "telephone" conversations by date, time, and duration. We documented 151 actual telephone calls from my telephone to hers in the 6 month period of May - October 2007. We documented DAILY internet contact from July 3, 2006 until the date I printed the documentation (10/15/2007), the only exceptions being when I was with her. She showed 22 date-stamped photos, a few from each visit.... including many wedding photos. She showed my passport and the entry and departure stamps. She showed our official wedding documentation showing we were married on November 23, 2006.

He wrote: "We need a bit more clarity of the relation because the timing is not clear. Please have your husband hand write a statement of your first meeting." He cited section 221(g) of the Immigration and Nationality Act as the reason for the denial.

I wrote the statement and they received it two days after the interview. I was told by a Vice Consul that she will be asked to return in 4 - 6 weeks and get her visa then. But why not at her interview? Wrong guy on the wrong day? This should not be so arbitrary!

  • 07/19/07 Completed preparation of I-129F & associated documentation. Mailed it.
  • 08/03/07 Received NOA1 from the CSC.
  • 12/13/07 Received NOA2 from the CSC.
  • 01/23/08 NVC sent our case to U.S. Consulate in Guangzhou China.
  • 03/31/08 U.S. Consulate in Guangzhou China received, issued case number.
  • 04/05/08 P3 received.
  • 04/06/08 P3 sent.
  • 05/01/08 P4 received.
  • 05/12/08 Flight to China.
  • 06/23/08 Interview at U.S. Consulate in Guangzhou China- PINK.
  • 06/25/08 K1 & K2 visas received.
  • 07/09/08 We all arrive in America, Chicago POE
  • 08/06/08 Fiancee receives SSN (req. for marriage in our state)
  • 08/08/08 Married
  • 09/01/08 Moved into new house. AR-11's filed for wife & son.
  • 09/19/08 AOS / EAD package mailed.
  • 09/25/08 AOS / EAD NOAs.
  • 10/02/08 Biometrics letters.
  • 10/16/08 Biometrics taken.
  • 10/17/08 Case transferred to CSC.
  • 12/08/08 EADs approved / EAD cards issued.
  • 03/05/09 AOS approved.
  • 03/12/09 Green Cards received.
  • 09/17/10 Application for Lifting Conditions Mailed.
  • 10/04/10 NOA1
  • 10/19/10 Biometrics Taken.
  • 01/07/11 Removal of Conditions Approved
  • 02/26/12 Still Happily Married & Doing Well

It took over 2 months and several emails, but late this afternoon (her time) my wife received a letter telling her to return to the US Consulate in Guangzhou and to bring her passport. Tonight she will be on a bus to Guangzhou (5-6 hours) and tomorrow afternoon she will go to the Consulate -- we waste no time!

Hopefully Friday she is given a positive response and told she will receive her visa sometime next week.

If so, we will be reunited before the end of this month. I'll keep you posted. Cross your fingers or pray for us. Thanks!

Tonight she will be on a bus to Guangzhou (5-6 hours) and tomorrow afternoon she will go to the Consulate -- we waste no time!

Hopefully Friday she is given a positive response and told she will receive her visa sometime next week.

Husband home finally - god what a journey....but after 400+ days we made it

It took over 2 months and several emails, but late this afternoon (her time) my wife received a letter telling her to return to the US Consulate in Guangzhou and to bring her passport. Tonight she will be on a bus to Guangzhou (5-6 hours) and tomorrow afternoon she will go to the Consulate -- we waste no time!

Hopefully Friday she is given a positive response and told she will receive her visa sometime next week.

If so, we will be reunited before the end of this month. I'll keep you posted. Cross your fingers or pray for us. Thanks!
