Just Curious Question, Anyone filed for hardship for not meeting their fiance?

Sorry there is an error in my title I meant to say has anyone Used Hardship as a reason for not meeting their fiance?

well yeh just wondering if you have or no of someone who has and whether their Visa was approved or not?

Trying to claim hardship is the most common reason k-1s are turned down. If it is a custom in the country not to meet your spouse in person then it is ok but they know the countrys where this is practiced. Not having time off work or not having the money are not hardships..

hmmm what if the problem is not because of money or taking time of work, like family preventing the individual from seeing the bf due to cultural reasons in a country like UK?

have not started my visa application, have not decided what route to take, planning my trip to America, and asking questions to see what best route to take . *breathes*.

Over the several years I've been following this and other immigration boards, I've seen several people try. I have not seen anyone succeed. I'm sure some people DO succeed, but from what I understand, success depends on either demonstrating that you are both long-time practicing members of an established religion which has a long-established prohibition on the meeting of marrying couples before their marriage, or that it would be an extreme hardship for the US citizen to travel. Extreme hardship usually means at least something like a medical condition that prevents airplane flight, along with an inability to use ground transportation to get to Canada or Mexico, and an inability to take an ocean liner. It's not enough to prove you can't get to your fiancee's country and your fiancee can't come to the US; you must also show that the two of you couldn't possibly arrange a meeting in some third country somewhere.

Inconvenience or financial hardship won't work. In fact, if you're too diligent about showing that it's financially impossible for you to meet, then you run the risk of giving them evidence to deny the visa on public charge grounds.

March 9th, 2010, Received GC that has been lost in the mail for 10 months. Still waiting for my son's that is lost as well.

Filed Waiver for my son's 10 year GC and it was approved. He finally received his GC after its been missing for 2 years.

Thanking God this is over for 10 years.

I guess I can't really understand why anyone would want to marry someone they haven't met. I have had met many people from online and rarely are they the same in person as they were online.

One more thing... If you're seriously interested in the subject and considering pursuing a hardship waiver on the in-person meeting issue, be sure and check out this USCIS Link before filing your petition. It shows the record of a number of final decisions issued by the USCIS regarding K-1 petitions. Theoretically, those cover all kinds of issues, but you'll see that a large number of the K-1 decisions had to do with people who thought they should be eligible for a waiver of the in-person meeting requirement, but the USCIS judged otherwise.

Be sure your case has fact that are significantly different than any of those that they've already denied. If the facts of your case look like one of the published cases that were denied, they will most likely follow precedent and deny yours, as well.

its that its not so easy for us to meet... his family dont like me for the fact that i am not christian and he;s turning 18 real soon so really hes not legal to marry me until he turns 18 in june ...and that my parents coming from the middle east dissapprove of love marriages... well ive fallen in love both with someone who i did not expect to like so strongly... but its happened ok.. my parents will never let me travel alone for the fact that I'm a girl and girls shudnt trvel by them selves abroad and ur gonna say take an adult no one really has an interest in going to america and im not going to spoil the relationship i have with someone whom im so inlove with... my moms threathened me before that if she ever found out that i hav had any relationship with any guy even as friends or if i break the rules (more like go against cultural practices and shame the family) they will send me back to where i originally come from.... my story sounds too interesting a bit like the Princess and the Marine anyone seen that movie lol... but yeh guys i bet ur all thinking oh what wud she know theyre both young.. but age doesnt matter and u guys dont know how we feel about eachother we really want to get married and thats that i dont want to stay in a pre martial relationship Im a muslim and I want to make this legit and marry him we both do....

theres not a day gone past were we havent emailed eachother or called... he;s also partially blind so im kinda worried for him to comeover by himself....

Yes... there are circumstances under which the 'meeting in person' requirement can be waived. However, from the information that the OP has provided, I beleive that trying to file for one of these waivers would be a fruitless exercise.

Agreed. Marriage brings up a ton more problems and issues than a K-1. All the problems that prevent you from meeting won't be resolved with a K-1 and will in fact get a lot worse. Add into that problems of money and it's a recipe for disaster. I believe the number one reason for divorces is money issues. It costs a lot of money to set up house and if you don't have parents to fall back on in an emergency, where do you turn to? My parents aren't particularly thrilled about my choice in spouse (to put it mildly), but we didn't cut them out of the process, didn't burn our bridges, and thank God, his parent and my parents have been able to help us out as we start out our life.

Plus, people differ greatly online from in person. I met my DH (dear/damn husband, depending on the day) online, and even after meeting 3 times in person, living together 24/7 on a permenant basis has brought up a ton more issues and problems we didn't even imagine would exist when we lived in our happy little online love world.

My advice overall? Be patient. If your love is true, it will be able to survive a few years while you both either go to college and then get jobs, or go and get jobs to start to build a firm base. My DH and I knew each other for 2 years before we met, and then waited another 2 years after that before we filed for the K-1 visa. We waited until we were financially independent and ready to make a life long commitment to each other. :luv:

Don't give up yet... yes the chances of being granted a waiver based on your case is highly unlikely but is meeting in person, just once, really beyond the realms of possibility ?? That is all you need to be able to prove to meet that fundamental requirement.

Stop trying to find a way AROUND the system and work out how you can work your situation to fit WITHIN the system.
