I130 approved, K3 pending can CR1 help to get a visa???

Hello people! Newbie here and i need HELP & a very good advice to our case. Originally we're a K3/K4 filer both filed for I-130 & I-129F. Based in the different reactions and experiences here in vj's forum mostly K3 filers in Vermont did not get the I-129F approvals unlike CSC. Our I-130 got approved last May 05 and we have an NVC case number assigned already but I-129F still pending. What should be the best route for our visa case? can we go to CR1/IR1? if we do, what will happen to the I-129F? I read one post here in vj his spouse CR1 visa was denied by the CO because his A/P for I-129F is still pending while other members do continue for CR1/IR1 visa even if their I-129F is still pending? Does anyone here knows the best possible ways which visa is applicable to us after NVC assigned us the case number. Im totally lost and we are very sad by this unbelievable visa process.

I also read on a post that currently if you still try to go the K3 route they will try to pair up the apps (I130 and I129f) I hope I am wrong but I would suggest the CR-1 route at this point. Congrats on making it this far!!

Nothing happens to your K3/I-129F. It's best to be pro-active with NVC. Did you read the information at the link I gave you?

Nothing happens to your K3/I-129F. It's best to be pro-active with NVC. Did you read the information at the link I gave you?

Yes i did read the NVC steps. Until now we are still waiting for the NVC's letter & machine says wait for 6-8 weeks to receive notification. Is it possible to apply right away w/o those documents from NVC? So our papers will start to process alrdy. Thank u again.

5/08 : Got Case # from NVC (received 5/7/08)

5/11 : PAID AOS Fee Online -- I-129F still pending; full speed ahead with I-130!

5/12 : Neetu emailed NVC re: DS-3032 (choice of agent)

5/13 : AOS Status now "PAID" -- AOS PRIORITY MAILED

5/16 : NVC received AOS

5/19 : DS-3032 email accepted & AOS entered in system

5/24 : IV Bill Invoiced and paid online

5/28 : IV Bill status = PAID -- DS-230 EXPRESS MAILED!

5/29 : NVC received DS-230 at 11:01 am

5/30 : DS-230 entered into system

6/03 : CASE COMPLETE - 26 DAYS AFTER NVC RECEIVED I-130

6/10 : Interview scheduled (for 7/9 originally)

6/14 : Interview letter (my copy) received.

6/16 & 6/21 : Medical

7/16 : Interview completed - APPROVED!

7/21 : Neetu picked up passport/brown packet from VFS

7/25 : POE AT EWR!!!

End of Sept: GC received!

I'm concerned about the I-129F being approved -- It's not as of yet, as far as I know ... but what do I do if it's approved before my wife's interview date? EEK!!!

You do nothing. No problem at all. Just go forward with the immigrant visa process and ignore your I-129F.

Facts are cheap...knowing how to use them is precious...

06/02/2008 : Online Payment AOS & IV Bill

06/04/2008 : Printed I-864; DS-230 & Barcoded coversheet

06/12/2008 : Sent I-864 & DS-230 Packets to NVC via USPS (overnight)

06/13/2008 : NVC received the Packets

06/16/2008 : NVC entered the I-864 & DS-230 into the system

06/19/2008 : CR2 Case Completed while CR1 got RFE DS-230 #2 & #20

06/26/2008 : Sent the corrected RFE DS-230 to NVC via USPS (overnight)

Originally we filed for K3/K4 because of my 5 yr old child. When our I130 was approved NVC assigned two (2) case number and until now I129F still pending but knowing Vermont's history lately doesn't approves I129F and instead petitioners are forced to take CR1. Under CR1 is my child can still go with me?
