****UPDATE: POE EXPERIENCE****

Hey guys! Just wanted to post an update about my experience at the POE while entering with my tourist visa. I arrived to the U.S. last thursday, and everything went fine, my POE was Houston.

It was pretty much like my previous visits, except that there were CBP agents in one of the halls of the airport before arriving to the Customs area, asking questions too.

On the hall they asked me, the following questions:

- What is the purpose of the visit?

- How long will you be staying?

- Where do you work?

- How much money did you bring?

- How long did you stay during the last visit?

When I got to customs, they asked me again:

- Is this your first visit?

- What is the purpose of the visit?

- How long will you be staying?

- What do you do for living (back home) and how long have you've been doing it?

- What kind of gifts did you bring? (they asked if I brought any food or tobacco)

I answered the questions as briefly as I could, I offered to show my old passport with the previous entries and my employment I.D. but he said he did not need to see it. I was surprised, they did not ask any questions about my fiance and as they did not ask any questions about the K-1 either, I did not mention it. (Just like at the embassy, I had brought all my papers again). Then he stamped my I-94 and my passport and dated them 'June 20, 2008', which means I could stay here for 6 months, too bad I'm going home next week :(

Did you apply for the tourist visa after you sent in your K-1 petition?

If so, I assume you answered "NO" to the questions on the k-1 petition that deal with previous visa applications and approvals/denials. Did you know you would be applying for a tourist while doing the k-1?

Yes, we sent our I-129F in April 2007 and I applied for the tourist visa in November 2007. (Back then I had another tourist visa that expired in June 2007).

About previous approvals/denials, there is no such question on the I-129F form. I was visiting my fiance in the U.S. (with my previous tourist visa) when we sent our I-129F so we answered "YES" to Question #11 and filled out the info. on Question #12.

There is one question about previous approvals/denials and visits on the DS-156 form(which is the same form I used when I applied for the tourist visa). Question #30/ Have you ever been issued a U.S. Visa: I answered "YES" and fill in the info. of my previous tourist visa. Question #31/ Have you ever been refused a U.S. Visa, I answered "NO". I still have not filled out this form for the interview. But my answers will be the same.

Back in April 2007 (when we sent our I-129F) I had no plans to travel to the U.S. again before getting my K-1. As time passed by, my fiance and I discussed the possibility of me visiting him in the U.S. again, but were unsure if I was going to be granted a new tourist visa while our K-1 was pending, at the end we decided to give it a try and I'm glad we did :)

Yes, we are still waiting :( When we re-scheduled they said it was going to be posponed until January 2008, but when I called the Consulate in December, they said that most likely it was going to be until February 2008.

This week I called the Consulate again and found out they are no longer giving info. on the phone due to the large ammount of calls they were getting! so I'm going to send an email again, asking if we have a date yet.

Do you guys have all your papers ready? I still need to take the medical exam and get my police records.

We have most of it done. My fiance has to go get his vaccinations and we will be done. I also have to send him the I-134, but I'll probably send it in a couple of weeks.

Congratulations. It's far easier to get a second visa after previous legal entry and exit from the US.

Sorry, but what do you mean? Would it really have any bearing on the K1 case if they used the B2 and followed its "rules"? I can tell you my husband had a B2 and our K1 was anything but easy despite never having any issues with leaving, entering, etc.

If you read the whole thread, you'll see that he was referring to a second TOURIST visa, he did not say I'd get a K-1 "easier" because I got a B-2 before. The approval/denial of a previous B-2 has no effect on the K-1 process.
