Today we went for our infopass appointment, we were told that as we feared the CSC sent us all the wrong instructions on what to do after the denial, wrong form, wrong fee requested, and a wrong procedure described. They were concerned that CSC might have sent wrong instructions to other people too, and if these people follow these instructions they might get in even more trouble. They said they are going to contact CSC on this matter and warn them that they're making mistakes. But all that doesn't change anything about my status, and unfortunately now that my AOS is denied my work authorization is no longer valid too.

We were given 2 suggestions on what to do next: either we can start a motion to reopen my case and once it's reopened my work authorization will be valid again, or we can restart the whole I-485 all over again and apply for a new work authorization along with it. They weren't able to tell how long will it take to reopen the case, and nobody can garantee if the case will be reopened and approved or denied again if we choose to do that. We decided we'll reapply for the I-485 instead. So hopefully this time it'll work out better for us...

12/21/05: Got married

12/22/05: Applied for SSN, had to do manual verification, 6-8 wks:(; completed I-693 vaccination supplement w/ local civial surgeon

1/09/06: Got SSN card in mail, this is fast!

1/20/06: Sent AOS, EAD and AP package to Chicago Lockbox

1/31/06: Received NOA1's for AOS, EAD & AP

2/3/06: Biometric appt letter arrived today (wow! that's fast!), scheduled for Wed. 2/22/06

2/22/06: Biometric done, but found out we had the wrong DOB filled out on her I-485, cannot be corrected at the time because her case isn't in the "system" yet. This is stressful.

2/25/06: I-485 touched

3/6/06: Infopass Appt in downtown Chicago to resolve the DOB issue. Had to send a letter to the processing center.

3/24/06: AP approved and sent in mail!

3/27/06: EAD touched.

3/28/06: EAD approved online

3/29/06: AP received in mail

4/29/06: AOS NOA2 received -- interview date June 28 2006. Online status shows still in process.

6/28/06: AOS INTERVIEW in downtown Chicago Sucess! Passport got stamped and Green Card is on its way!

7/8/06: Green Card arrived

I-751 Remove Condition

4/28/08: Sent I-751 package to NSC

4/30/08: NOA1 date

5/12/08: 1st NOA for biometric appt on 5/28/08

5/16/08: Another NOA for biometric appt on 6/5/08, we are confused

What a big screw up by them huh? You shouldn't be the one punished here. They should re-consider your appeal. This wasn't your fault anyway. I feel sorry for you but this is so wrong! Hope things work out for you. Goodluck on the appeal and God Bless! :(

Sorry Anastasia...why not try the appeal process first?

You cannot file an appeal on that decision, the law is complicated but basicly that's how it is, all you can do is file a motion to reopen or reapply all over again. As I mentioned before, if I ask them to reopen my case I have no idea how many months it will take, and in the meantime I cannot work legally. If I reapply for AOS I can also apply for EAD along with it and get my work authorization back in 3-4 months. Financially it's very important for us that I will start working again as soon as possible.

Hi Anastasia, yes I've been told the same thing about all the process of appealing. And today we are going to appeal it to avoid they revoke me my EAD. In my case, as many of you know now, I've been denied because they didn't accept my divorce in Las Vegas, since I'm living and I was living (at that time) in California. The Inmigrations office, who interviewed us, advice us to do a new divorce in California, which is in process now, then remarry my actual husband and then reapply, I mean do EVERYTHING again. The appealing is, as I told you lines above, to avoid them revoke my EAD, since I can't do anything else now until june that I'll be divorced and I'll be doing all the process again. What a headache!!

I think you made the right decision. A new I-485 is going to be faster than a MTR and you will be able

to work as soon as you get a new EAD, which shouldn't take more than a couple of months.
