We just submitted the I-129 on the 13th, so I am a bit of a newbie.

This may be a foolish question but I am just wondering if it will possible for my fiance to travel outside the country during the period immediately after we are married. Other than the legal wedding ceremony, what else would have to take place before he is permitted to travel?

Posted (edited)

Nope. You'll have to apply for Advance Parole if you want to travel out of the country before the green card arrives.

Revised to say: You can travel, but your husband will not be admitted to the US without a green card or advance parole document.

8-30-05 Met David at a restaurant in Germany

3-28-06 David 'officially' proposed

4-26-06 I-129F mailed

9-25-06 Interview: APPROVED!

10-16-06 Flt to US, POE Detroit

11-5-06 Married

7-2-07 Green card received

9-12-08 Filed for divorce

12-5-08 Court hearing - divorce final

A great marriage is not when the "perfect couple" comes together.

It is when an imperfect couple learns to enjoy their differences.

May I suggest a nice honeymoon in the good old USA. K1 is a single entry visa. Once you're married, you file to adjust status, work authorization and advanced parole, for travel between its granting and the green card issue.

FAQ:

6.7)...Can my spouse leave the United States, and then re-enter, before receiving the Green Card (conditional permanent residency)?

A...The spouse cannot re-enter the US unless they have "advance parole" authorization (application form I-131). Advance parole allows you to re-enter the US before approval of Adjustment of Status. Without advance parole approval, leaving the United States is considered an abandonment of your application for Adjustment of Status. Without advance parole approval, the USCIS (INS) will consider you an intending immigrant without a valid visa, and you will be denied entry. If you do not apply for advance parole when you file for Adjustment of Status, contact your local USCIS (INS) office to find out how long it takes them to issue Advance Parole. Although advance parole is supposed to be issued to anyone who wants it for any reason at all, some local USCIS (INS) offices may take weeks or months, and may require proof of a serious emergency.

Lots of great places in the USA to honeymoon, you know. I might suggest the Upper Peninsula of Michigan... Might be slightly "middle of nowhere," but it's scenic and peaceful... ahhhh...

Ok - again this might be a dumb question... how long does it take to receive conditional permanent residency from that point? Is there a timeline you can direct me to?

Usually it takes about no more than 90 days, I think

But to lift the conditional, it takes 2 years after marriage and then you can lift it and have a green card for 10 years.

We asked the same question too. We went to San Francisco and then to Maui. Maui/Hawaii is in the USA and is a fantastic destination to go to. We were originally going to get married on a K1 Visa, hence why we booked this trip.

In the end I came in on an L1A Visa due to a work commitment and we could therefore have travelled anywhere we wished (and we went on a cruise to Mexico without a problem) but we still had a fantastic time in Maui and would recommend it as a Honeymoon destination.

My advance parole took a few months to come through, so the USA honeymoon was our best option and I'm glad we did it.

We celebrated our first wedding anniversary this weekend!

Can be as short as 90 days but can also take YEARS to get.

Best thing to do is file for AP (I-131) when you file the I-485 to adjust status.

There are so may places to see and things to do in the USA, your fiance is coming to the USA I would think they would like to see more of the country that they will be living in.

Good luck friend,

Tanffy

No more than 90 days? Under 90 is historically pretty quick.

The fee for the I-485 now includes the I-131 and I-765.

I think "tanffy" is thinking of the AP (I-131) processing time, NOT AOS (I-485) processing time.

No travel outside of the US unless you have received an Advance Parole. Given all that you have gone through to be together, why bother with the expense and aggravation of filing yet another immigration document that won't be approved before your wedding anyway?

The US is large enough for you to find a really nice, memorable honeymoon destination.
