Timeline

Hi everyone I'm posing a questions for someone I know, her and her husband has been married for 2 years in the USA and she is a US citizens and he is not. They had their interview but they had to miss it cause she has cancer and she had to get her treatment. Now their interview is in January in Cuba and they was wondering how long will it take to get their visa and come back to the USA. Please help me. Thank You so much for your time. :help:

Why is their appointment in Cuba if he's in the US already?

That's why I asked.... Because he's from Cuba and he's already here... Why the need to go back there?

Cubans have amnesty so he never should have gone back it looks like...looks like someone gave your friends some bad advice. He probably could have even adjusted without the marriage since he's Cuban.

Anyway, to answer the question, you'd have to look at the timelines for the consulate in Cuba (although I know it's a weird situation in Cuba....they are treated so differently because of the political climate).

Not he should have stayed in Cuba - but could have stayed in the US and not returned to Cuba. I would have hoped they'd spoken to a qualified immigration attorney, but it doesn't necessarily sound like it...

I do think they wiill need an attorney, or what do you think, cause he is here illeagel and now he is trying to be legeal, but the embassy said that he have to do everything in Cuba they have already sunt his papaers to his mom's address in Cuba so i really dont know what will happen. I was tellin her about this site and she told me to post her question and see what the results will be. Right now she doesnt have assest to a PC so that is why I she told me to so this for her.

Okay, so he's in Cuba right now?

If he's already there, what's done is done. I still think they should get a qualified immigration attorney, because it seems (from what I have read, and in knowing people from Cuba who came here illegally and got their residency regardless, without having to return to Cuba) that your friend got some bad advice. It would be a shame for them to get bad advice and have more problems. I'm afraid that's all the advice I can offer at this point.

The vast majority of Cubans don't have to return once they arrive here. I think it's called the "wet foot/dry foot policy". Officially, Cuban Immigration Act of 1996. It is irrelavent how they get here according to US immigration officials.

There are a small number of Cubans who are asked to return to Cuba because primarily they have broken the laws of the US in some form.

In general, Cubans can't come and go unless they have permission from the Cuban government.

My fiance was in Argentina for 9 years, 1996 to 2005 and out of status. He had to ask for permission to return, which they did allow. The Cuban government also paid for his plane ticket home. Cuba made him pay for that plane ticket before he left for the US on the k-1.

I'm not quite sure what's going on in this situation however, it sounds like we don't have all the facts. Your friend should be honest about what's going on, it's the only way we can offer any usable advice. Remeber it's all just advice.

This (what's in bold) is what I was going to say. Cubans don't even need to marry to adjust legally.

I work with a woman who requested permission to stay for a year (her tourist visa was for 6 months), and then she adjusted status and now has her residency. She told me that you have to be in the U.S. for a year before you can adjust status.
