hi,

I filed a k-1 petition for my fiance. He receieved the visa, but we broke up. And now we are not together anymore. He hasn't came to the U.S.A yet. But I don't want him to take the advantage of that visa and come here. Therefore, I want to cancel this case as soon as possible. I am not sure wether to call the embassy or the uscis here. Anyone has an Idea of whom I should contact?

Sorry to hear it didn't work out. With the K-1 visa, he can't really come here and just stay here (well legally) If he doesn't marry you within 90 days of entering the U.S. then he's out of status. Not sure who you contact to stop him from coming to the country but I got a feeling that would be difficult todo. Most (if not all) K-1's have a validity of 6 months, meaning he has to travel to the U.S. within 6 months of the issue date of the visa. If he doesn't come here by then he can't come here at all.

If you could indeed invalidate his visa, then all they can do is reject him at POE, which is sorta stupid if you ask me.

Sent a letter to the USCIS and an e-mail to the Embassy. You should receive a notice of withdrawal from the USCIS within 90 days.

If he's got the visa in his hands I am not sure if the Embassy would be able to contact him and make it void, you can contact USCIS and tell them you're withdrawing and who knows, maybe he'll be prevented from entering US in his POE, but otherwise since he won't be marrying you in 90 days he'll be out of status after that period of time and subject to deportation.

Yep even if he does come over on it,he wont get married to you anyway (he cant get married to anybody else with that very same Visa even if he wanted to)

If he comes he comes and if he overstayes he is in danger of being deported anyway.
