Ok,

I sent in both the I-130 and I-129F. It seems to me it will never come trough the USCIS route.

Can I request Direct Consular Filling of at least I129F?

For you information:

I went to congressmen to see if they can help. Visit was no help at all. The caseworker went on the USCIS web site and printed most recent receipting update and processing time. I was little rude saying " I can do that myself, going to the web site and do that. Is that kind of the assistance you are providing. Printing out the info of the website." The worker also said “ No miss, I am in congressional screen”. I said “ Well that congressional screen is no different from regular USCIS web site. Hahah what a BS!!!!!! Some corny politicians….

But wait! Their computer is much better than yours! It's 2 years older, 100% slower, and it probably cost $3.5 million. And you got to sit in a $2500.00 chair - and if you happened to use their bathroom - there's that $2000.00 toilet seat in there.

*cough*

But more on the serious note. If the petitioner has lived in the country for a certain period of time ( I think it's a month or months ) - then I think DCF can be used. I know, in my case - I'm a dual citizen with my filing country ... but I'm not eligible for DCF - because I don't live there.

( This coming from an Arab who married an Arab from overseas... go figure. )

Hahaha, you are right about the chair. :)

Anyhow, the USCIS mentioned they are no longer do I-130 for people residing in USA. But they said nothing about not accepting the I129F. :))

I-129 can only be filed with a service center.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

DCF is only available for cases in which married couples live abroad (both of them), and it results in a CR or IR-1 immigrant visa. So it does not apply to a K type visa.

Hope this helps

Not a K3 visa either. The above is absolutely correct. If you want a K3 visa, there is no direct consular filing available and any DCF requires the USC has qualifying residence abroad at the time of filing.

Facts are cheap...knowing how to use them is precious...

Direct consular filing is only available if you are living in the country you are filing in and meet that countries criteria for DCF (living there for a certain amount of time - varies by country).
