Rejection Notice - HELP!

Hi all,

So all of our papers were returned to us today and the Rejection Notice states that it's because we did not file the correct fees. My 485 check was for $1,010 and (sadly) the one mistake I made was filling out the 130 check for $335 instead of $355.

SO, my question to you is -

How do I send it all back with the correct amount? When I sent everything out, I made it all out nice, everything seperated with all the cooresponding documents and evidence. When they returned it, different forms were stapled together and all of my pics and evidence and medical exam results cae in a big ziplock bag.

Should I sent it back as is, with the correct checks attached to the forms and a letter, or should I take apart what they have done and completely reassemble the package?

I cant believe after months of preparing I made the dumbest mistake EVER

I personally would put it back together in the same way I originally sent it to them. With the correct fee this time

Consider yourself lucky they got around to it fast -- you only wasted 10 days or so, so don't feel so bad about however long it took you to prepare the whole thing!

Edit: to answer your question, there is no proper way to refile -- you can either re-arrange the package the way you first did it to avoid any problems/mess when they get it, or return it to them the way they returned it to you and let them sort it out themselves. They sort it out themselves when they receive it anyway, so it's up to you... but like I said, I would re-arrange it my way before re-sending it.

When I filed for Claudeth's AOS and EAD I only wrote one check.

Yea it looks like everything is all out of order. I mean, they kept everything, but stuff is stapled to things together that make no sense (all of my wife's passport copies are out of order and in weird places, a lone hotel receipt attached to my 864, etc)

I'll probably take the day and organize everything again and then send it out tomorrow instead of rush and send it back out today.

Do I have to include a cover letter explaining what I'm sending?

Send it back the way they sent it to you - why create more work for the person opening it, since they'll have to reoganize everything the way they wanted it again? (And I'm sure there is some kind of standard way of assembling when it's received in Chicago.)

And even if there isn't, it'll be torn apart SOMEHOW by someone in Chicago, so you'd just create unnecessary work for yourself.

Speaking as someone who forgot to sign a cheque when submitting her AOS forms, and who forgot to check off a box on her removing conditions forms, I had both sets of papers sent back to me. Both sets of papers were rearranged. I left them alone, signed the cheque, checked off the box that needed to be checked, and sent it back ASAP.

The AOS was taken care of quickly, the removing of conditions -- well, I am stuck in TSC in a situation that I had nothing to with other than my filing date.

Long story short, leave your package alone, put in the right fees and send it right back!

If you sent the I-130 Petition for an Alien Relative, then you also should've included a check for $355.

$1,010 covers the 485 plus fingerprints and EAD and AP

So after discussing it with the wife and reading your thoughts, I decided to just return the package as it was sent to me, and attached a cover letter explaining that I had done so and was including the checks in the proper amount. My fingers have gone back to the crossed positon.
