I was wondering if anyone knows a good immigration lawyer for a K1 visa in the USA. My fiance lives in Charleston SC. Were not sure if its a good idea gettin an online lawyer or to actually see one in person. If anyone has any tips or advice what to do or who to get, i'd greatly appreciate it..Thanks

Hi there, I'm also from Scotland and now here in the States waiting on my adjustment of status. I wouldn't recommend paying for a lawyer. if your case is straight forward just follow the guidelines. In hind sight it is not a difficult process just a lengthy one. VJ is also an excellent source of information and support, so if you have questions this is the place to write where you will no doubt find an answer. It is obviously up to you and I know it can be a scary process at times. What you will need is patience. Good Luck.

Like you when I first came on this website, Nicholas and I had decided to hire a lawyer. After finding VJ, we changed our minds completely. If you have a straight forward case...you can totally do it yourself.

Just look under the Guides up top and it tells you step by step everything you have to do and when you have to do it. Then, if you have more questions, you simply ask on these amazing boards. The people here are so super helpful!!!

A lawyer costs a pretty penny and then once you enter the U.S. to adjust your fiance's status, it's over $1000.00! Save your money for that.

If you work together, take it slow, you can totally do it on your own.

Dont waste your money on a lawyer unless your your case is complex you dont need one. Their track records are not very good, they really dont care and there are many horror stories about their mistakes and indifference.

Nov 2nd 2006 met online

June 28th 2007 sent 1-129f to NSC

July 11th 2007 NOA-1 received date on NOA-1 (now at CSC)

July 19th 2007 NAO 1 Reciept date on NOA-1

Nov 21st 2007 NOA-2

Dec 13th 2007 - arrives at NVC

Dec 20th 2007 - leaves NVC on route to GUZ

March 10th 2008- P3 sent & returned

April 9th 2008- P-4

May 22nd 2008 interview

Tracking:

Filing to Noa -1 -13 days

NOA-1 to NOA-2 - 133 days

NOA-2 to NVC - 22 days

NVC Processing - 7 days

NVC to GUZ - 81 days

P-3 to interview - 73 days

Hmm...I don't have any suggestions on lawyers...I'm sure someone will be able to recommend someone great.

Ok so I've been thinking about this and I still don't think you need a lawyer.

You say you'll have your divorce papers in January 08. Why don't you wait a little bit of time after that and then file.

What more can an immigration lawyer do for you, honestly? They are basically paid proof readers. When I contacted the one we were going to hire, he just wanted us to get together all the paperwork and evidence and send it to him. We still had to do the work. He just put it all together for us at the cost of 1800 bucks!

Maybe someone else has a different opinion but I think that you should still try it on your own....just be honest in your petition and I'm sure you'll be ok.

Ok so I've been thinking about this and I still don't think you need a lawyer.

You say you'll have your divorce papers in January 08. Why don't you wait a little bit of time after that and then file.

What more can an immigration lawyer do for you, honestly? They are basically paid proof readers. When I contacted the one we were going to hire, he just wanted us to get together all the paperwork and evidence and send it to him. We still had to do the work. He just put it all together for us at the cost of 1800 bucks!

Maybe someone else has a different opinion but I think that you should still try it on your own....just be honest in your petition and I'm sure you'll be ok.

Is there a reason to wait once i am divorced. Wont it take at least 6 months before i have my interview at the London Embassy. The main reasons i feel i need for a lawyer is that .....1- Ive been married to a US citzen before.....2- Stupidly married while i was on the VWP......and 3 i overstayed less than 2 months

I don't know if there is a reason you have to wait...I just thought maybe it would look better....

If you really feel you need the assistance of an immigration lawyer, go for it.

It all comes down to what you and your fiance are most comfortable with.

You may have seen advertising by attorneys such as "100% Success" or "no visa was ever denied"......this is because attorneys in general will take cases that they know will be successful. When you ask them to take a chance with complicated or unusual cases, they normally refuse it. I know because when the new IMBRA laws came into effect, I and a couple of other people in this forum were one of the firsts to be affected by it.

My efforts in getting an attorney to take my case was useless...I guess they were more concerned with their "100 % success". I can say that when the chips were down and you really needed them, I was really on my own. That is not to say that all attorneys are the same or that you should not use them; what I am saying is unless your case is complicated and beyond your comfortable zone, you can usually do as good a job and sometimes even better because you have a vested interest in the outcome.

There is lot of help in this forum and most members will tell you that in hindsight, whether they have used an attorney or not, they could have saved themselves $$ and done the job themselves. In my case the forum was very helpful and eventually I was able to do it myself with some help from my fellow members. Most full service attorneys will charge in excess of $1500 and up. If you do decide to get one there are many out there in the web. I would recommend using one referred to you by someone that was happy with their results. My list of attorneys is extremely short....sorry!

I suggest you seek other points of view from other members and hopefully you will be in a better position to make the right decision for yourself. I hope that my remarks has helped your in a very small way. You alone can decide what is best. Best of luck :)

I'm not sure about the visa waiver program, but from what I have read on here as long as you didn't overstay by more than 6 months you will be ok. I used a lawyer because I had 3 of the 11 red flags and wanted to be certain that I didn't miss anything in proving the validity of my relationship. Had I found this site before I hired the lawyer I probably could have done it on my own. The only thing that my lawyer had me send that the VJ list didn't include at the time was my fiance's passport. So he saved me time from an RFE I suppose.

Unless Im reading this wrong, you need to be divorced before another visa can be petitioned for. (But if Ive got the wrong impression, I apologize).

Lol. Yes i know i need to be divorced. If all goes well that will be through end of January 2007. Applying for K1 soon after

Off all the forums, immigration websites i have seen in the last year or so. This one is way the best by far. Iv'e talked to my fiance in the states and she says the same. Going by what ive seen from very friendly and helpfull people in here i think we will just apply for the K1 visas ourselves. Save some money instead of getting a lawyer. Thanks for the helpfull posts and we hope we can get some help in filling in the forms if need be.....Thanks again
