Hello Guys,

Is the K1 Visa really the best option to bring a fiance over to the US?

I have already applied for the K1 and received my NOA1. So I have about a 4 month wait til I receive the NOA2. (If there is no RFE) Then there are the other steps ahead... I mean its a lot of work and preparation.

However, I am still pondering if this is the easiest / best way to bring my fiance over.

There just seems to be too much paperwork, preparation and time needed to accomplish this.

One of the reasons we applied for the K-1 was because my fiance was denied of her tourist visa. If she was approved, I think we would not have to apply for the K-1. Wouldnt it be easier to go that way? She can re-apply for a tourist visa. Then we can just get married in the US?

Another option also was to apply for a student visa. I have helped an an ex-gf before in applying for a student visa. It wasn't that difficult. There requirements aren't too much as the K-1 and its much faster. Plus the schools are willing to help. (cause they get paid and you have to pay for school every month to keep the students here in the US)

They school just needed a certified bank statement of $20,000 USD for the applicant, a registration fee, copy of the passport and an interview at the US embassy.

What are your thoughts?

Sure it might be easier but what are you going to do after the marriage? Will she go home and await a spousal visa? Because circumventing the immigration law by using a non-immigrant visa to gain entry to the US in order to immigrate is a big no no.

If you apply for a student visa, and then your fiance comes to the U.S. with the intention of getting married and staying in the U.S. permanently, that is visa fraud. I doubt you would even be able to get a student visa now that you have a K-1 visa pending.

Your best bet is to stick with your K-1 visa application.

My fiance did stick with the K-1 Visa because I didn't want to risk anything for that matter.

We want to be 100% Legit! :)

However, I was just thinking of the "what if scenario".

I know several international students who married US citizens. I do not think that is fraud. Unless it is a fixed marriage. (marriage with no love). It is more convenient because they are already here in the US.

For a tourist visa, I do not think that can be considered fraud, if the two truly love each other.

This forum is not for the purpose of circumventing the immigration process. If, this is your fiance, and you intend to marry, file the K1 and wait your turn.

Hello Guys,

Is the K1 Visa really the best option to bring a fiance over to the US?

Other options are to go to the forign country and marry there, and then file for a spousal visa, though it wont make the process go any faster.

We did the K-1, and were just patient about it, chatted every day, talked on the phone, and the 8 months of waiting went by very quickly.

You say you filed for K-1 yet your profile shows filed for N/A, how about updating your profile?

For a tourist visa, I do not think that can be considered fraud, if the two truly love each other.

If you come to the U.S. as a student, then meet and marry a U.S. citizen and remain in the U.S., that is fine. But to apply for a student visa, with the intention of coming to the U.S. to marry a U.S. citizen and remain, that is visa fraud.

Same for a tourist visa.

They probably entered the US before meeting the USC and if not, didn't come here to marry but to study, and things turned to the way of marriage. It's fraud to enter with the intent to immigrate.

Marriage without love might be fraud in some sense but it is not VISA fraud.

What you "think" is fraud and what is legally looked at as fraud are two different things. Applying for a tourist visa with attempt to marry is legally fraud.
