k1 visa expired and AOS not yet been submitted

I entered US with a K1 visa and it has been expired last Sept. 2. A financial crisis came up along the way and don't have the $1,010 amount yet to start the process, and it worries us a lot for this might affect of my stay being out-of-status. I might not start to submit the necessary documents until mid of November.

I never have a good nite sleep thinking all this and makes me feel sick. Am I allowed to have a baby sitting job for the moment?

I REALLY NEED TO HEAR ALL YOUR COMMENTS/SUGGESTIONS.

I-751 Lifting Conditions Timeline

April 06, 2010 - mailed I-751 documents via usps express mail(overnight)with delivery confirmation

April 07, 2010 - packet delivered and signed

April 12, 2010 - check was cashed

April 13, 2010 - received NOA1 (dated 04/08/10)

May 07, 2010 - Biometrics

May 10, 2010 - Touched

June 23, 2010 - APPROVED WITHOUT INTERVIEW!!!

We waited a year to file for AOS will the name check being the only problem. So please do not worry about that. Annie carried a copy of the K-1 visa and the marriage certificate with her in case it ever came up. It was never needed, but it was better to be safe than sorry.

Technically, you can not work. But when you adjust from a K-1 any unauthorized employment is forgiven.

Take out a loan to pay the fee?

If you wait too long to adjust status, you might have to have a full medical exam which will add even more to the cost.

Once you've entered the US, your visa is dead. Its expiration date is of no meaning to your status, whatsoever. You have 90 days to marry the petitioner. If you did that, you're legal. There is not specific time frame within which you must file AOS. However, there are advantages to doing so sooner rather than later, advantages like work authorization and the ability to leave and re-enter the USA.

The visa expiration date only applies to how long you have to enter the USA. You've entered. The visa is dead, expired over, finished....

I assume you married before the I-94 expired so you shouldn't have anything to worry about. File the AOS when you can but keep in mind the beneficiary is restricted with what they can do without AOS.

We've run into a similar situation. Because some ding-dong entered Ahmed's date of birth wrong at the POE he was unable to get an SSN and therefore no DL, ID, job, etc. Without him able to bring in extra income, it took us alot longer to scrounge up the moolah for AOS (and that was before the fee increase). We got married within the 90 days, but waited almost another 2 months to file AOS. As long as you married within 90 days, you're fine.

As mentioned above, working is a no-no. And as also mentioned above, a loan is a possibility. I have had good success in the past with small unsecured loans (very helpful when buying plane tickets to visit the hubster). Hope things work out for you. And try not to go nuts while waiting to work. :)
