Can my fiance delay turning in "checklist"

Timeline

My fiance is expecting her first packet from Saigon consulate. I understand there are forms and checklist she has to sign then send back to the consulate. Can we delay sending in this form for about 6 to 8 weeks? The reason is I don't want using a cosigner. So, by delaying the interview until late January 2008 give me a chance to get this year W-2, file tax, get a certified copy at local tax office and send it to my fiance for her interview. TIA

Good strategy. The delay will be no problem. Perhaps you can rush your employer or they are just fast with the W2, but they actually have until January 31 to get you the W2.

You could also just request the interview be after a certain date. You don't need a reason.

The I-129F notice of approval is good for 4 months IIRC. Look for an expiry date on it.

I sent in my checklist about 2 months after receiving it because we were waiting for a police certificate from another country and some other documentation.

You also don't need a W-2 to file - you can use the last month's (or week's) pay-stub for filing. However, if you need other things like bank statements, Property tax statements etc. - then you may have to wait. If not, then you can file on Dec 31 and when you get your W-2 send a copy with the copy of the electronic filing (yes you can print a copy when you file electronically). Many people file on Dec 31 - we had to have our electronic filing system (Colorado state) up by Dec 31 to allow people to file that early - there were always a few people doing it that early. Good Luck

I sent in my checklist about 2 months after receiving it because we were waiting for a police certificate from another country and some other documentation.

The expiration date is only of significance if there is reason to deny the visa. Otherwise Consular Officers have teh authority to and routinely extend the validity of petition approvals. It is quite common for the process from NOA2 to interview to exceed 4 months, even without intentional delays.

My Fiancee did not send her check list in at all. She called the consulate in Ukraine and they told her she did not have to send this to them.She never got her packets at all. We down loaded them unline. Oh and she got the Visa with no problems. She said it was easy and they on;y looked at about 1/3 of our paper work. And they asked her 1 question. Well that was Ukraine. Other consulates my be different. Good luck !!!

W2 forms are part of a tax return. Supplying a tax return without W2 or/and 1099 forms is incomplete. A W2 is not a substitute for a tax return but might be accepted with an I-134 at the discretion of the CO.

Our consulate asked for: I-134, Form 1040 AND W-2.

you won't have to delay anything. the Consulate will not desire to see your tax-return untill the interview. the interview is 3 months after your fiancee returns the check-list.

I would suggest NOT rushing your employer.. i work on the accounting side of a business and we have someone waiting for a visa trying to rush us on stuff all the time. but we have to send alllll of our financial stuff to a specialised accountant for taxes so we cant rush him and if we tried to he could mess something up for that person or the business.

EAD Approval was NOT updated online. We had an infopass meeting for 3/6 and then the EAD shows up in the mail on 3/5!!!! cancelled appointment,
