I want to bring my fiance to the US as quickly as possible. He is a Brazilian citizen and currently lives and works in Brazil. I am trying to figure out the best option to move him here as quickly as possible.

Any thoughts on the best option?

1) get married in Brazil and apply for the spouse visa. From the research I’ve done thus far, it seems there is some paperwork/holding periods in Brazil as well.

2) apply for the fiancé visa and get married here. (I worry that if we do this, he will not be able to return to Brazil for a certain period of time. Our actually wedding ceremony will be in Brazil next September and I need him to be able to attend, obviously! :)

3)get married in some other country with fewer marriage restrictions such as Mexico, then apply for the spouse visa

4)Other options?

Quickest to get him here is the K1 because you can start the process now. Any spouse visa process cannot start until after you have proof of marriage.

You concerns about travel back to Brazil are valid, however. Most would advise not to make actual wedding plans until you have the visa in hand. If not being in Brazil next September for a wedding is a deal breaker, then you'll have to deal with that. K1 visas require the actual legal marriage to occur in the US. If your "wedding" next September must also be the legal one, you can do nothing until after next September.

Hi,

Unless I misunderstand something, there is obviously something wrong here. If you bring him to the US on an Fiance visa, you have 90 days within which time you must get married or he has to return to Brazil. In other words, a Fiance visa presumes that you will be married in the US during the 90 day period. You can't return to Brazil for "[Y]our wedding". Maybe you didn't understand that, or maybe you are referring to someone else's wedding that you feel you must attend, as another poster assumed.

Nobody assumed anything of the kind. A "wedding" does not have to be a "marriage". The legal marriage must occur in the US, to the petitioner, within 90 days for a K1 visa holder. If a legal marriage in September of 2008 is critical to the life plan, they are well advised to forego any visa petitions until after the marriage takes place.

The OP said "wedding" not "marriage". We don't know if the wedding mentioned was planned as the actual legal marriage but they now have the information they need on that subject.
