Tax return - How to get tax return for 2005 that wasn't filed

Timeline

I didn't make any money during 2004 (full time student) so I didn't file. There is no record in IRS since I didn't file. IRS people gave me a paper that says there is no record for that year. NVC asks for last three years tax returns. Any help would be appreciated.

If you didn't have to file in one of the last three years, send two tax returns and a letter explaining why you were exempt from filing for the missing year.

you can still file for that year.

Goto any tax filing place HR Block ...ect

and they can help you for a fair fee and get it filed.

Just claim zero.

I would take the letter from the IRS with you. To them. Have them make a copy for their records on filing.

You hang on to the original as you can use it when submitting tax records.

December 12 2006 Filed I130

Jan 10 2007 got receipt and case number!

Jan 12 2007 sent 129F

Feb 6 notice they were moving the file to a faster service center.

Feb 26 Notice of I130 approval

Feb 28 2007 notice they were sending 129F to USCIS for further investigation (err #######?)

May 15 2007 notice of approval of 129F with processing dates of 05/15/2007 thru 09/14/2007

May 28 2007 Notice from attorney that NVC needed processed and money orders were needed.

June 4 2007 Traveled to Manila to spend 2 weeks with my wife!! (YeHaaaa!!)

Fed-xed her signed papers (For NVC) from Manila to attorney from Manila while on vacation

June 18 2007 Nvc approved support.

June 29 2007 packet arrived @ my home informing of interveiw for I130 on Aug 27 2007 and explaining Medical interveiw.

(Note wife never received packet for I130 in Philippines I fed-ex'ed mine to her for medical interveiw)

July 17 2007 packet arrived for 129F setting interveiw for Sept 5 2007

August 5 2007 Wife flew to Manila for medical interveiw on August 6.

August 26 wife flew to Manila for I130 interveiw on August 27 2007.

August 27 2007 12:31 pm I130 Approved

wife arriving Nov 18th

WIFE ARRIVED Nov 18th!!!!

You must alwas file even if you do not make money. To not file is very easy to resolve if you do not owe taxes. File out the form 1040A, delare no income and submit to IRS. Take copy of filing and send it with the other two years. Simple. If you do not owe money there is not penalty for filing late at this point. If you don't file someone is going to ask why.

so file it now and make copies of what I am filing to IRS and send that to NVC. Am I correct?

How long do you think it would take for the IRS to enter this in their system so I can get the original IRS copy? I still have more than 3 weeks from getting my I-184. What do guys think?

If your gross income less than $8,450 and you meet the other requirements, there is no law requiring you to file.

For the NVC you can simply print out the requirements proving you are not required to file. (The IRS doesn't provide you with a copy of what you file unless you request a tax transcript after filing).

Absolutely right kit kat. seatleguy, just remember, the threshold amount that triggers the requirement to file is different each year, so you would have to find the amount for 2004 (the year when you didn't file).

Also, note that this requirement to file or avoiding filing is for the IRS; it is possible the consulate/embassy your spouse will interview at will insist on a tax return or transcript each year. There is nothing preventing you from filing for 2004 with 0 income.

I am a US Citizen and was living in India for 21 years. I never in my life filed tax returns because I was not working in India (nor in USA before I left). I returned to USA in 2005, started work in Jan 2006, and 2006 was the first year I filed tax returns. I submitted an explanation letter and a printout from the IRS website of who needs to file tax returns, both at the Consulate level and now for AOS. All going smoothly so far and no one has asked me about it.

I also ordered a free tax transcript from the IRS website, asking them to specify that I did not file returns for those years. I got back the transcript for 2006 and a box checked stating no returns were filed for the other years.
