Does G-28 form help with RFE response?

My indian fiance attended his K-1 interview and was refused under 221g - not a denial, just a request for additional evidence. We've gathered all required evidence requested and prepared our response despite the challenges of getting notarized documents to India from the US and of getting us both listed on a bank account.

 

It was recommended to us that we get an attorney to complete a G-28 form to submit along with our response so it shows we have representation, to eliminate the potential for 'discretionary abuse of power'. 

 

My question is would this actually help? And has anyone had luck finding an attorney willing to just do this form and not charge for the entire case?

Mod hat off:  I see no need for the G-28.   It won't help an RFE response.  I see no benefit for obtaining an attorney as the consulate wants only evidence of your continued relationship.    In addition, the letter mentioned a DS-260.  That is not applicable to your case.  Personally, I see no need to have a joint US bank account until after marriage.  That is when mingled finances will be important.  Just my opinion.   Good luck on your journey.

Correct.  Evidence of relationship that is dated after the visa denial is not helpful. So I agree the joint bank account opened after the interview is useless and worse, it looks like contrived evidence.  Focus on evidence of time spent together in person before the interview.  What were you getting notarized?

The RFE asked for notarized statements of relationship in the last bullet point - we did submit notarized letters of intent with the original petition in Dec 2024.

When I reached out to embassy, they said they made an error listing DS-260, and said it should say DS-160 instead.

 

We want to submit a strong response - he went to the interview and feels the refusal was based on the fact that the documents weren't organized the right way. He went in with a ton of evidence, and the interviewer simply asked to see a photo and nothing else.
