Hello everyone,

 

The I-130 petition that my wife filed in January 2025 was approved on January 23, 2026! It took one year and there were no additional requirements.

 

We live outside the US, so NVC will send us instructions to file the DS-160 application before February 20, 2026.

 

Is there anything to keep in mind regarding the documentation to be submitted with the application?

 

For example, my wife's U.S. criminal background check is more than 6 months old. Is that a problem? Anything else?

1.  DS-160 does not apply to spousal visas.

2.  There is no US criminal background check document required for a spousal visa.  That is handled by USCIS as part of the internal process.

You might want to become an "A" student of the I-864 and the spousal visa process.  Guides are here on VJ.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

DS 260 not 160.  Actually no "background check" is required.  It's not called that for Spain or most other countries, but nothing from the US for either petitioner or beneficiary.  A more complete records check is in the file.  USCIS has much more thorough access than anything available to the intending immigrant, or US Citizen, for that matter.

Facts are cheap...knowing how to use them is precious...
