Hello, I am a USC petitioner for my husband and stepson (separate I-130s, submitted at same time). NVC shows the AOS fee as 'Paid' for both after I paid it once in my husband's nvc case. We are only trying to complete NVC stage for my husband, as we are postponing my stepsons case for now. So wanting two different timelines of completion here for my husband and stepson

Questions :

  1. Can I use I-864EZ for my husband even though on his i-130 I noted I have also filed for my stepson? Or should I do the standard i-864? I have paid husbands IV fees as well.
  2. Is it okay to only submit the i-864 for my husband now and delay my stepson’s case by a year? I have read that as long as I periodically check in with nvc, it will remain open. We did not pay the IV fees for my stepson yet

1.  Personally, I would submit an I-864.

2.  Just don't submit documents or fees for stepson's case.  You can postpone his case indefinitely by contacting NVC at least once every 12 months.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Submit the I-864, not the EZ version in this case.  I should add that even though it is not technically incorrect to use the I-864EZ in your case, it's no extra work, and saves any confusion on the part of NVC.  Just leave the asset section blank.  It's optional anyway.
