I think here 2-3 years now, and currently working 'a la izquierda'.

They got married in US 6 mos ago thinking that would help, and he now has 2 US citizen children from 2 different mamas. The LPR has 3 years wait left to apply for citizen.

Ah. So a 10 year ban unfortunately. Is this his first time in the US, he's never entered illegally previously?

He should really leave asap and get the I-130 filed so the clock starts ticking, and his wife can then apply for a waiver of the ban to get him back sooner than 10 years. Hopefully by the time the PD is current and the waiver is granted, the country ban will have been lifted or amended too.

What matters is if the non-citizen had a legal entry at a port of entry, period. The 10 year rule thing can be done in an immigration court but it seems like they're no where close to that.

Marriage is irrelevant....US citizen children are irrelevant.  If they entered the US without inspection, they can't stay.....and bans are real unless waivered.

I heard the government has increased the incentive to self-deport to $3000 along with a ticket to home country.  This administration is serious.
