Hello - 

 

I havent seen too many examples of similar situations so posting here. My child is a USC, 22 and mentally incapacitated. I have all the docs and I have full legal guardianship. I'm in the US on a work permit with her. When I read the I-130 instructions it kinda indicates that a legal guardian can sign. But then can I sign it when I'm the beneficiary? Legally she cannot sign anything, so I'm not sure if I should just sign this and send it? She can't even do the interview as she cannot speak, so I would just be going there alone. I did a lawyer consult, they said they would get back after checking and are no longer replying to me. Hoping someone has been through a situation.

Thanks… No spouse unfortunately, yea I’m going to talk to another lawyer, just trying to avoid another consult fee for no outcome. Will def use a lawyer if we file. The I-130 instructions specifically say - “A legal guardian may also sign for a mentally incompetent person.”. So I’m hoping we are covered…

This doesn’t sound like a DIY case since you are the guardian AND the beneficiary and the US Citizen petitioner is mentally incompetent, very slippery slope.
