I had an interview in January and due to some mistakes from my lawyer, I was asked to send some documents regarding my application. My application was updated in February and I've not gotten an update ever since then. I've sent the embassy multiplr emails, one in august ad last one 2 weeks ago. What do i do?

Which consulate and what visa? What documents did you have to provide?

It was an F1 visa, Montreal Consulate. Because of how late my family lawyer submitted the visa, I passed the required age. I was told they could still give me the visa, if I could send documents to prove that i'm still eligble to get it.

F1s are not age capped. Presumably a derivative?

 

On what basis are you eleigible?

Then it’s not a green card, it’s an immigrant visa. So F1 category, but why is age 18 relevant? Derivatives are under 21, not 18.
 

So you’re a derivative of the main applicant? What’s the Priority Date, how long did the I-130 take to approve and how old are you now? 
 

You say the lawyer submitted the application late so is the issue that you didn’t seek to acquire the visa within a year of one becoming available? Or that you’ve aged out? What documents did you provide? 
 

Sorry for all of the questions but it isn’t making a lot of sense so far, so we need more info to help you.

Yes it is a derative, my apologies, not used to the words being used on here. The applicants are 21 and 23.

Yes, both actually. The visa became available in 2022 and due to my parents not knowing better and putting everything in the hands of the lawyer, we did not know we had to seek the visa within one year. Luckily, our lawyer told us that we have some documents showing that we tried to start the application but we were not getting a response from the embassy or NVC regarding some documents.

Ah, I see. Do you know what your lawyer sent that he didn’t get a response to? That he sent to NVC? (Anything sent to the consulate isn’t relevant, as it’s the visa application stage that is crucial, not after that). 

 

Sounds like your lawyer has completely messed this up for you. I hope he’s refunded you!

I am alittle bit unsure due to the fact that he sent the documents in 2023. I just wanted to know when i can get a response from the embassy.

It would depend on what he sent and whether the docs supported you having a valid reason for not meeting the deadline.
