I’m eligible to apply for citizenship based on marriage. I got my GC back in 2022 after adjusting status from ESTA. My case is a bit different because me and my husband had K1 pending at that time. In 2020 embassies were closed and k1 was not being processed for awhile. I decided to go and visit my husband (back then fiance) on ESTA. Our k1 was at NVC at that time. During my stay the circumstances changed and we decided to get married and file for AOS. My gc was approved and during the interview the officer did ask how I entered the states and if we had k1 pending. That was it and no more questions. Am I in the clear? All these articles about ICE and arrests stress me out and I keep delaying my application.

Also we have a son together, house and tons of things with both our names. Of course it’s a genuine marriage.

When I entered on ESTA, the CBP officer did ask what the purpose of my stay is and I said I’m visiting my finance and his family, he said ok and to have a good time. That was it. I never misrepresented myself.

also we never officially withdrew the K1, I was told that it will expire on its own. Would that cause any issues? 
 

I’ve been seeing so many posts and articles how they screen you throughly for citizenship and they’re literally trying to find anything so your n400 won’t be approved

Your case is similar to other cases when people adjusted from ESTAs or non-immigrant visas. I adjusted from work visa and naturalized earlier this year.

 

I don't see major red flags. If your marriage is strong and bonafide, you can apply for citizenship.

I had the exact opposite experience. I found the N400 interview to be a very pleasant experience and felt that they wanted me to become a citizen as well. 

Problem with the information age is that positive articles do not sell ads so they are not popular. And most people post online because the run into issues not because everything went according to plan.
