Not sure that makes sense, I 601? Is this Consulate or Adjustment.

If you read my post you would not asked that. The was on AP, they never gave me a response until I contacted the congressman office to contact the embassy, that’s when they said to apply for a different category because the k1 past the 6months deadline because of covid. Never requested a waiver.

married 2020, apllied for cr1, interviewed last year may 2, 2024. That’s when the officer told us he couldn’t approve the ir1 visa because of the misrepresentation for the k1 visa in 2018, but he will contact us. 30 days later we received a denied letter requested a waiver.
contacted a lawyer june 2024, she emailed the embassy to find out the reason, they never responded. Contacted congressman office March 2025, they said I need to do the waiver so they can remove the misrepresentation from our case.

Waiver submitted may 1st, payment received may 9, but until now no receipt.

 To clarify my post

In 2018 we had our k1 visa interview, only my fiancée went. They asked to send in an original document but kept his passport, he did that, then the status changed to AP, January 2019 covid hit. I sent emails and called but they never gave me a response until I contacted the congressman office to contact the embassy, that’s when they said to apply for a different category because the k1 past the 6months deadline because of covid. They Never requested a waiver. We got married in 2020, 2021 I applied for a spousal visa (cr1), 2023 we transferred the case to DR, interviewed last year may 2, 2024. That’s when the officer told us he couldn’t approve the ir1 visa because of the misrepresentation for the k1 visa in 2018, but he will contact us. 30 days later we received a denied letter requested a waiver.

Waiver submitted may 1st, payment received may 9, but until now no receipt.

I think Boiler's point is that I-601a is for overstayers, not inadmissibility. So just to confirm, did you mean you'd applied for I-601?

Sorry, just realized I didn’t post the full explanation

Still seems to say it's a waiver for misrepresentation that you needed? So I-601, not I-601a? What exactly have you filed?
