Hello all

Has anyone have experience with F2B vis denial under 212(f)?

Background

My brother in law is 100% Chinese, currently in China but have a Venezuelan passport since he was born there. MIL applied 05/2016, and recently had the interview. Got denied under 212(f) under Trump's ban. Is there anything we can do? I already asked couple immigration lawyers and they all say nothing they can do. There is very little information about this type of denial and i am wondering if anyone had this type of denial during Trump's first term and were you able to get Visa after the denial or steps to get the denial reverse? Any help or advice is much appreciated. thank you!!

You say your BIL is ‘100% Chinese’? So he has a Chinese passport? I didn’t think China allowed dual nationality but if he does then there are exemptions to the ban and having dual nationality with a country that isn’t banned is one of them. https://www.whitehouse.gov/presidential-actions/2025/06/restricting-the-entry-of-foreign-nationals-to-protect-the-united-states-from-foreign-terrorists-and-other-national-security-and-public-safety-threats/

As I understand it Venezuelans just have to wait. How long I can not tell.

if the ban is lifted ( most likely wait out this presidency), then what would be the process to get his application to be reconsider again? Do we put in another application now which will take another 10 years?

Should not require a new petition.  Essentially the current petition will remain in stasis until the ban is lifted relative to Venezuela.
