Hello,

My wife arrived to the US in June 2024 after being married for more than two years. Married June 1 2022 and arrived June 11 2024. Had interview at embassy January 2024. She received a 2 year cr1 visa in error two months after arrival. Filed an I 90 for replacement online in september 2024, but it never asked when or where to return the incorrect original green card (filed online with uscis account). 9 months later the correct replacement, ir1 10 year visa, arrived in the mail. My question is what do we do with the original physical green card made in error (2 year cr1 green card)?

I'm not aware of any official instruction on what to do in this case. Here are some options:

 

Option 1

On GC, there's mailing address printed saying where to send it if found. You can mail it there and it will be in USCIS possession. If you choose this option, I'd use some mailing option with proof of delivery. Then keep proof for any future reference, if USCIS asks what happened to that GC.

 

Option 2

Keep the GC in safe place. During naturalization interview or oath ceremony, you may be required to bring all of your green cards and other IDs issues by USCIS. You'll surrender it then.

Just to clarify for others that may read this post.  She was properly issued a CR1 visa as at the time of the interview you were married less than two years, but she entered the US after your second wedding anniversary so is entitled to a 10yr GC (you say IR1 visa, but at this point we are only talking about the physical green card).

 

That being said, I agree with @OldUser, you can follow either path they laid out for the erroneously issued 2yr conditional green card.
