Hi, 

 

My spouse filed an I-130 Petition in 2021, while we were residing in the UK. Prior to petition getting approved, we moved to the US on an L1 (somewhere in July 2022). Our petition was approved later that year and I subsequently filed an AOS with USCIS and was granted GC in 2023. I received the below email earlier this month saying that I have not contacted them in more than a year. I have to contact the NVC and give them one of the four options. I am a little concerned with the tone of letter and the wordings - "I do not want to pursue my immigrant visa application". I don't know what they mean by "not pursue my application". Any advice on what to do next?

Letter from NVC 

 

After U.S. Citizenship and Immigration Services approved the immigrant visa petition filed on your behalf, the U.S. Department of State's National Visa Center (NVC) sent you instructions for completing your immigrant visa application, paying fees, and submitting required documents. Our records indicate that you have not contacted NVC in more than one year to submit these items.

U.S. law requires immigrant visa applicants to apply for a visa within one year of availability. Section 203(g) of the Immigration and Nationality Act requires the U.S. Department of State to terminate the registration of any alien who does not apply for an immigrant visa within one year of notification that a visa number is available.

 

This letter is notification that a visa number is available.

 

If you do not pursue your immigrant visa application at NVC within one year of the date of this letter, the U.S. Department of State will begin the process of terminating your visa application.

If you wish to pursue an immigrant visa, please log into the Consular Electronic Application Center (CEAC) at https://ceac.state.gov/IV in order to restart your case. Please note all applicable fees must be paid again. By logging into CEAC, you acknowledge and understand you will have to resubmit all required fees and documents in order to continue the immigrant visa process.

If you are no longer interested in pursuing your immigrant visa application, please inform NVC of your intentions by completing the Public Inquiry Form at https://nvc.state.gov/inquiry. In the "Type your Question Below" text box, please indicate ONE of the following:

 

  1. No, I do not want to pursue my immigrant visa application because I have adjusted status. (Please attach a copy of both sides of your alien registration card.)
  2. No, I do not want to pursue my immigrant visa application because I have received an immigrant visa through another petition and am now a permanent resident. (Please attach a copy of both sides of your alien registration card.)
  3. No, I do not want to pursue my immigrant visa application because I am no longer interested in immigrating to the United States
  4. No, I do not wish to pursue my immigrant visa for a different reason (please provide explanation).

 

If you do not reply to this notice within one year of the date of this letter, your immigrant visa application will begin the termination process. If you have any questions, please contact NVC by following the instructions online at https://nvc.state.gov/ask.
