I am sympathetic to the issues the OP is dealing with relative to their health, but I am uncertain what is being asked here?  The OP says a sibling filed an I130 in 2018 for what I presume is an eventual F4, the person in question is currently in the US with what might be a withholding of removal order.  What exactly is the OP asking for?  Since they did not file the I130, they cannot request an expedite based on their condition.  The F4 category is far from current, so the existing I130 is just collecting dust right now.  Not seeing much that can be done immigration wise.

 

To the OP, I feel for what you are dealing with, and hopefully the outcome is more positive that what the Drs. say, but I am not seeing anything you can do to help your son's situation unless you actually file an I130 for him yourself.  The I130 your daughter filed cannot be transferred to you.

I'm really sorry about your cancer, and the situation you're in, but I don't think you're understanding. There is NO visa available to him by law until his Priority Date is current. So there is no way to expedite it (unless you can get a new immigration law passed!). 

 

But if he's with you in the US then hopefully that will suffice for now, at least you can be together?

 

Have you and your daughter both petitioned for him? You say you applied in 2025?

He cant adjust status, presumably the plan is then to file I 601a? Assuming it is still around? Assuming there is no other issues as that only covers illegal presence. Then interview at the Consulate.

 

Withholding of Removal strongly suggests a Lawyer is involved not DIY. Perhaps OP would be best talking to the Lawyer, but son and sister should be fully aware of what is going on.

Unfortunately, that is not how that works.  Your visa category is numerically limited.

 

I am an oncology nurse and I wish  you well in your treatment.  Myeloma sucks, but there are many new treatments available, especially immunotherapy.  Also good ol' bone marrow transplant.  I hope you have access to a top tier cancer center, or even an MM specialty center.  Best wishes.
