Hello, 

 

I have received a letter from USCIS that my Form I-485 has been denied because I have not subbmited Medical examination and vaccine records, when I did sent it mid Feb and also received it back end of Feb with a stamp on saying they have received it, together with an update on my online account, saying on case status that it has been received and reviewed on March 4.

 

I have attached my appeal letter bellow,so you can see the full story, please let me know if this is ok to send to them to reopen my application. 

 

It would be greatly appreciated.

LETTER 

 

To Whom It May Concern:

 

I am submitting Form I-290B to respectfully request that USCIS reopen and reconsider the denial of my Form I-485, Application to Register Permanent Residence or Adjust Status, which was denied on May 5, 2025. The reason for the denial was stated as failure to submit Form I-693 (Report of Medical Examination and Vaccination Record).

 

However, I did submit Form I-693 along with Form I-601 and supporting documents, including:

 

• Family/Friends and Church from Croatia letters

 

• Vaccine records

 

• Form G-1450 for the $1,050 fee

 

These documents were mailed together to the address provided in the USCIS letter dated November 27, 2024. This course of action was also recommended by my Civil Surgeon and the Boundless agency assisting with my case.

 

In March 2025, I received all of my documents back, along with a letter dated February 21, 2025, which advised me to call USCIS for assistance regarding the fee. I called USCIS on March 4, 2025, and read the letter to a representative to ensure I had submitted everything correctly. The representative confirmed that my documents had been received and that no further action was needed.

 

I called again on March 6, 2025, to reconfirm, as my case status hasn’t been updated and was once more assured that my documents were received and under review. On March 7, 2025, my USCIS online account was updated to reflect this, stating:

 

"Response received on Tuesday, March 4, 2025, at 12:10 a.m. EST. We will review the evidence."

 

I believe the denial may have been the result of a miscommunication or an error, due to the following:

 

• Online case status indicated that the evidence was received and under review.

 

• The USCIS letter dated November 27, 2024, provided only one mailing address, so all documents were submitted together.

 

• All forms, including the Form G-1450, were stamped as received on February 19, 2025.

 

• USCIS representatives verbally confirmed twice that everything had been received and no further action was required.

 

These confirmations led me to believe that all required materials had been properly submitted and were being reviewed.

 

Enclosed with this motion, please find:

 

• Copy of Form I-693 (stamped as received)

 

• Copy of Form I-601 (stamped as received)

 

• Proof of submission and delivery of Form G-1450 for the $1,050 fee

 

• Delivery and tracking confirmations

 

• Screenshots of the USCIS case status update and call logs

 

• Letter from USCIS dated February 21, 2025

 

• Copy of the I-485 denial notice

 

Given the above, I respectfully request that USCIS reopen my case and continue processing my I-485 application. I am more than willing to resubmit any documents, if necessary.

Kind of weird, when USCIS accept documents including I-693, they do not return them.

 

Calls are great, but at least names of agents to be included, otherwise it's hard to prove you ever called.

 

What was $1050 fee for? I-485 fee is $1440

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

What was $1050 fee for? I-485 fee is $1440

The fee is for Form I-601 weiver, I have a screenshots from calls, time and date

Yes I have all documents received back and stamped as received then online case status updated to that too

Note that your other duplicate thread has been removed, please keep all info to this thread only and don't start new threads on the same subject. What status are you trying to adjust from?

 

Your posts are rather confusing. What else have you filed with the I-485 i.e. I-130? Have you had an interview? What other fee payment did you include? Can you give us a complete timeline and when you sent when?

Sorry, I had a comment bellow to move this post to adjustment of status topic, so i did.

I have written in the letter above that I have included with Medical examination and vaccine record with the waiver and the fee for the waiver (religous examination for taking the vaccines that we required, and that was only flu booster, I have had all other vaccines as a kid) All those forms have been returned and stamped a received, then 3 months later, now this month, I have received a letter from USCIS, same department that my adjustment of status have been declined because i did not sent them those required forms above. But i did!

The comment was telling you it had already been moved to the AOS forum.

 

The query is how you're applying for I-601, what status you're adjusting from, and what else you've filed along with the I-485? It just doesn't sound as though you're eligible for what you've filed for, so I suspect we're missing some vital info.

I-130, Petition for Alien Relative, I-485, Application to Register Permanent Residence or Adjust Status, I-765, Application for Employment Authorization, I-131, Application for Travel Documents, Parole Documents, and Arrival/Departure Records, all these forms have been sent together, then following on Form I-485 was required medical examination, I have already got my work visa approved in beginning of January, now all has been declined as they are stating that I haven't sent them the med exam.records, when thwy have requested it in November, but I did sent it all before the dedline, which was end of feb. Is there a way I can show you screenshots and images proof of it all?

Ah, ok. It was the I-130 bit we were missing! So you've had the I-130 approved? Who is petitioning you? And what status are you adjusting from (i.e. did you enter on a visitor visa, on an employment based visa, etc)?

 

We don't need to see screenshots. If you've submitted everything for the I-120B then hopefully that will work.

So my petitioner is my husband that is from USA, i had it all approved expect the form I-458 that was pending, until I have sent them those other forms they have required, and yes I have all the proof, my forms returned back to me with the stump as received, bills from surgent practice, that i have paid for the examination, tracking number when i have sent it, most importantly, case status was showing received and being reviewed after I have received my forms back, so march 4th, and had a phone call 2 times confirmed all received no other action required. Sending an appeal today, that was the letter above, do you think I should add or remove something?

Again, what status are you adjusting from? Is he a US citizen? What's the I-601 for? 

 

Your letter looks fine to me.

In my unprofessional guess, it seems to be that it is relatively simple:

 

  • You got denied because you didn't submit a medical form and vaccine records.
  • This makes sense because they ones you did send them were returned to you because of an issue with the fee you sent. Hence, the adjudicator no longer has them in their file. 
  • You relied on advice from the tier 1 USCIS representatives who don't have access to paper file to see they were returned to you. Seem like your agency didn't advise you properly too on what to do when you got them returned.  
  • You didn't say if you literally saw the medical form uploaded in your online account.

I would think your appeal should focus on the issue at hand, that you did send the medical records and USCIS told you they were all set and had all the paperwork.  You will need to clearly explain why you didn't re-send in the medical forms when they returned them to you.  I don't think the extra words such as "as advised by the civil surgeon and Agency" are helpful .. that is just blaming others for what you should have done or known .. but that is my opinion.    Personally, since your life is depending on it, you may want to consider a lawyer cleaning it up and adding some legality around it since surely there are some laws that are relevant.    But since you have a very good case showing you submitted them and then were misled by USCIS that you don't need to send them in again, or perhaps USCSIS didn't see the ones in the online account (you need to check this) ... you have a solid case without a lawyer .. upto you
