My JSON file countdown to zero more than a month ago, I applied March 8th, no interview notice yet however today my estimated time went to 4 weeks. I am hoping for interview notice soon. My husband applied same day also his estimated time shows 6 months

Good day, I need some guidance. I understand if no one know anything on the subject. Here goes:

I am pending I 751 removal and submitted for my N 400 on March 26, 2025 using the 3 year rule. Unfortunately, my husband passed away on July 10, 2025 and I really have not been thinking about the interview process. Right now I dont know which way to turn or how to move forward. Any advice or a point in the right direction is appreciated.

My deepest condolences. That's a major loss, and I understand you being swamped.
You will need to convert your I-751 to a waiver. You'll need to complete a new copy of the I-751 with the Waiver or Individual Filing Request section filled in, along with a letter showing your spouses death certificate and a request to convert the existing request. You may also want to contact your local USCIS office to inform them of the needed change. Your converted I-751 should continue without issue and you shouldn't need to pay fees again.


If your USC spouse dies before your oath, you aren't eligible under the 3 year rule (https://www.uscis.gov/policy-manual/volume-12-part-g-chapter-2). You'll need to re-apply under the 5 year rule. I'm unsure if you're able to "hold" your existing N-400 until the 5 years are up, or if you'll need to abandon this one and refile. Perhaps another member here will know, but I know that original application cannot continue.

I'd recommend @Roxy&Ryan to withdraw current N-400 and file new N-400 when they have been LPR for 5 years.

I'm so sorry for your loss. I have a friend who request for a combo interview and her spouse passed away months before her interview. But she didn’t know that she need to filled a waiver before her interview. So, when she attended her interview they cancelled her N400 and moved her to 5 year rule but they make her i751 interview and she passed. 

 

My recomendation? Search and filled a waiver 🙏

There is no such waiver for N-400

Thanks everyone, I really appreciate the responses. Does anyone knows the link for the I 751 waiver? I will also try calling my local office tomorrow for guidance.

They won't help.  You either send a letter to USCIS to modify your existing I-751 or you submit a new I-751 annotated as a waiver submission.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
