She will be the legal age with written consent in the state we plan on getting married in 6 months her parents are going to give written consent, i guess what i need to find out is if she can file for it before she turns legal, as the marriage will obviously not occur until so.

If you read page 3, item C on the I-129f petition, you will note that as long as your underage fiancee has written parental consent to marry included with the petition, you are good to go with filing now.

You mean it will be another six months before she is legal to marry, even with parental consent?

I don't want to rain on your parade. But there are realizations to the visa process. You have to keep in mind there are a lot of factors that could come into play and could cause delays. Keep reading these posts and look at people's timelines on this site. Some have gone fast, some at a normal pace, some have gone slow, some are sitting and waiting in an abyss without any knowledge where they sit in adminstrative review. You can get a generalization of the visa process. But there's no guarantee any of this process can be completed in 6 months or less.

Understandable, im willing to wait however long it takes and make sure to get everything right the first time round and make sure we have a solid standing in everything, anymore advise is welcome.

Concerning letters of consent how should they be laid out?

The age of marriage with parents consent in wisconsin is 16, it has to be notarized consent infront of the country clerk, will this change anything with the written consent included in our claim?

My understanding is you will need to wait to file the 129-F until she turns 16 in six months because she needs to be of age to marry (in this case, including the parental consent) at the time the forms are filed. Someone will correct me if I'm wrong.

One aspect that has not been mentioned yet is that she needs to be 18 in order to sponsor you for adjustment of status.

If you start now you may be out of status for an uncomfortably long time before you can apply to adjust.

I've just got done visiting my fiance in the u.s for three months, we decided to get married about 6 months ago now that i have returned we need to start work on filling stuff out for the k-1 visa, the only problem is she does not turn the legal age to marry until feb 1st of next year, we dont want to wait until then to start filling out everything, so is it at all possible to get the process underway now before then in time?

Is it not possible for anyone else to sponor you for adjustment of status, such as her mother? I will be able to financially support myself with savings.

I just need to be sure...we can apply now and be aware of any other problems...or easier options i should be taking?

The main sponsor will be your wife, even if she has a co-sponsor.

I'd wait, visit more, and be sure I was making the right decision. After which you'd have more knowledge of the process, more evidence, etc.

We both know this is the right thing, she is my soul mate, and we both need eachother right now...she isn't taking it too well.

Welcome to the waiting game. Everyone on here is a participate and no person is an exception. 18 years of age is considered the legal age in US to be an adult. Being "out of status" are usually not good words. The best advice I think any of us could give you and your fiancee' is for her to consult with a family-based immigration attorney which you could receive probably more options and/or better advice to your situation that no one here would know about. This is just a visa discussion forum. Getting sound, legal advice from someone who specializes in immigration visas I think would be more helpful to you both.

If you are saying this girl is 15, then absolutely it would change my claim. I thought she was six months from 18. A visa could not be granted until she's 16 but I don't know if a petition could be approved before that or not. As others have pointed out, your "wife" must be 18 in order to sign the binding sponsorship contract, no matter who acts as a joint sponsor.

You are going to have to wait a while regardless, but before making these life decisions, in you case, I would certainly recommend consulting a qualified immigration attorney.

A key issue to being out of status is that you would not have authorization to work.
