K3 / Divorce Decree Question

When submitting my I-130 packet, does the copy of my divorce decree need to be certified? I tried to search previous forum questions about this subject, but it is still unclear to me. If not, is there another time in the process when I might need a certified copy? I don't have a problem going to get one, just curious of it's a problem for the initial I-130 submission. Thanks for reading.

The ask for a copy of your divorce decree but it needs to have the clerk's stamp on it where it was filed. You will need the original later in the process when you have an interview and make sure it it is official one from the clerk's office. I have read where interviewers will question it if it does not have the official stamp from the clerks office.

Although the I-130 instructions don't specifically ask for "certified copies" of divorce decrees, it is customary to submit them.

Item 7.

2) If either you or your spouse were previously married, submit copies of documents showing that all prior marriages were legally terminated.

You don't need a certified copy to send with your I-130 to the USCIS. You may need one however to present at the embassy at the time of interview.

05/03/07 - NOA2

05/10/07 - NVC receives petition, case # assigned

08/08/07 - Case Complete

09/27/07 - Interview, visa granted

10/02/07 - POE

11/16/07 - Received green card and Welcome to America letter in the mail

Removing Conditions

07/06/09 - I-751 sent to CSC

08/14/09 - Biometrics

09/27/09 - Approved

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

I had an original copy (with clerks stamp). Photocopied it, sent the photocopy in with the I-130, no problems.

I had an original copy (with clerks stamp). Photocopied it, sent the photocopy in with the I-130, no problems.

A photocopy of a certified copy or a photocopy of an original with court stamp is ok for filing. Remember, it is only a page or two documentation they actually need. The reason for using Certified copies is that they contain only the vital statistics of the divorce, not the property settlement etc.
