Hello All,

 

I had filed a petiton I-130 for my spouse (husband) to immigrate to the US. We live together in Saudi Arabia currently. I am a US Citizen.

 

Our petition was approved and my spouse received the Visa Interview on 17th Dec 2023.

 

After the interview, his passport was kept by the embassy however the Visa refused under administrative processing and petitioner proof for Intent to domicile in the US.

 

Few weeks back we got an email that administrative processing is completed.


We have already submitted proof of petitioner intent to domicile in the US to the embassy. 
 

Need to know if someone has had the same case and if Visa can be approved without me actually traveling alone to prove domicile in the US?

 

Also can the embassy reject our application altogether if they are not satisfied with proof of intent to domicile?

Please correct me if I’m wrong. Deny means that my case is still open and I can show further proof of intent or actually domicile and get my spouse’s visa approved.

 

Or the denial means that I will have to file the dreaded i-130 case again?

You don't have to file I-130 again for the same beneficiary if you remain married. Your relationship was established.

 

Denial meaning visa was denied.

If you file again with valid proof of domicile, it should get approved. This is my understanding. Others can correct me.

Yes it does say “refused” currently.

 

I submitted the below evidence:

 

- Rental agreement for the place we intend to move in to.

- Opening US bank account.

- Transferring funds to US bank account.

- One way flight air ticket to US.

- Job searches

- Job offer (for my spouse)

- Mobile plan

 

any more suggestions or recommendations?

 

What do you think. I hope this should be sufficient to prove intent to reestablish domicile.

This seems pretty good to me.
 

Do you have a valid driver’s license or one you could renew online? Are you registered to vote? If you have kids, are they registered for school?

Yes I am registered to vote.

 

No drivers license or kids in school age.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
