It was no fees earlier. Do not know if that has changed. Best and quick option will be spend few money and have a virtual call with an attorney to the most accurate result. A call with an attorney for a 30 mins will cost you 100-250. And I would advise that just sending the application will not result in anything. You have to send proofs. If an application is only been sent it may denied initially and no prima facie will get issued. So be cautious don’t rush get attorneys advise.

Hi folks, i have been on this forum for a while and learnt a lot here. I filed Vawa in 2022 and got approved May 2025 with i485 concurrent filing. I received RFE for medical and it's been 3 months now with no update. How long does it take to get interview or approval? I did reach out to USCIS and they said all i can do is wait. I have not seen my family in 5yrs and really want to travel this year. What can i do?

Any application send with a fee waiver will not have any problem as far as you are qualified for that benefits.

They will first adjudicated the fee waiver and if it's not approved,

1-They will ask you to pay the appropriate fee on the best scenario or

2- will send back your application in the worst scenario for you to resend with the appropriate fee 

So nothing to be afraid of as far as you send all the files concurrently.

But you have to list all the forms attached to your waiver form.

Nothing to be afraid of.

It's the process and USCIS goes by it.

Did they asked you to send the medical or to bring it during the interview?

In my case, after sending the medical, it took less than 3 months.

But all depends on the workload in your field office.

It's a good sign as they had RFE you already for medical.

Soon, everything will be over.

since it is over 90 days. I would say make the info pass appointment or contact your representative.

Congrats. The application would be transferred to local office and depending on the local office work load it will get scheduled. What month did you file in 2022?

Thank you. When i filed concurrently, the i485 was transferred to vermont and i received the transfer notice. I did call USCIS and they said my service center is San Bernadino. I don't have any paperwork that states that. The last transfer notice i received was july 3rd, 2023.

Thanks so much, i have contacted my representative. I am new to the info pass thing. Does it mean i schedule an appointment to know what the status is? Won't they just tell me it's still under review?

1.  Yes.

2.  They might -- but they'll have the most recent status.  See if they can stick a pin in their colleagues to move on it.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

yes you would schedule a appointment to your field office. Most of the time it is very beneficial.

As for me, I will go with the Congress person first.

Interview is not mandatory to scheduled in 90 days.

It's first depends upon the workload in any field office and also on the complexity of a case.

Just be a little bit patient and wait for your representative queries feedback.

In case you found it difficult, scheduled an info pass

When did you file i360? Earlier before SCOPS existed all vawa applications used to go to Vermont. Now 485 always goes to local field office.

If you weren't in the critical period (between RFE and decision) I'd ask if you have applied for advance parole, however in this case even if you've got it, I'd recommend against any international travel until you have your green card in hand for one very simple reason: It's easier to fight any possible denial while inside the US, if you get denied while abroad you're kinda just screwed and would have to do a whole another process of getting an I-824 to transfer the case to NBC, then DS-260, medicals again, consular interview, and it's just a massive mess to fix. 

 

I'd recommend reaching out to your senator or congressman and having them contact USCIS on your behalf over attempting an infopass. The process is pretty simple, you go to their house or senate page, look for contact link, send them a message explaining your situation, they will send you a privacy release form that you will then need to fill out, sign, and send to them. They will then send that to the USCIS congressional liaison that will make whoever is sitting on it take a look and report back. It's not uncommon to hear "it'll be done when it's done" and then a day or two later see something happen because someone had to pull them out the stack to investigate and at that point they might as well just push it forward. 

 

I do not recommend trying infopass with VAWA cases. The privacy protections of VAWA simply hide most things from view of rank and file employees so they might see very little or see nothing at all, especially now when it's unclear where the case is currently at. RFEs for medicals typically originate from the NBC (in Lee's Summit, MO), but they can also originate from the local field office, and theoretically they could also originate from Vermont/Nebraska. The field office has geographic jurisdiction, they were able to tell you which one it is by where you live even if their system didn't show them anything.
