There is no waiver which is why the question presumably died.

 

They cannot deny him entry they can take his GC and refer him to an IJ.

 

Wonder of he will get a NTA.

 

I am not sure she did it right or there is something missing, taking what we have the I 90 could be the way to go.

 

They never asked him what basis he was trying to enter. They told him if he'd gone with ESTA he wouldn't have had any issues. 

 

I think in the end they allowed it based on being the parent of an American child, but his intention was to come here to live and work as an LPR once he got his green card renewed. 2 of my children and I had already moved back to the US and we won't be leaving again.

A legal resident doesn't qualify for VWP.   Have you spoken to an attorney?

Ah I didn't realize, I guess if he had to go back we'd have to find out where to go then. Hopefully it doesn't come to that!

I would file the I-90 and wait for their response before worrying about the I-485.

Ok, I will see what we can do. I'm a bit wary of immigration attorneys, the last one we consulted stole £3k from us 😕 (for a different matter, but it still makes me very wary).

HES BEEN APPROVED!! We applied March 25, he had his biometrics appointment yesterday and literally walking out of the building got the notice they are processing it. 

 

I got a notice at 4:43 am that action had been taken on his case, to see this:

 

 

Card Is Being Produced

We have approved your Form I-90, Application to Replace Permanent Resident Card

 

 

They had said it would be 6 months to make a decision from yesterday, it was less than 24 hours!
