My son will be sponsoring my husband soon. He was filling out the I-130 and one of the questions there asked (Page 5 - Question 10): Has anyone else ever filed a petition for the beneficiary?

 

26 years ago I tried sponsoring my husband from Canada. I don't remember which forms I did, but at the end it wasn't successful because the officer told us that the only way I could sponsor him is if I moved to the US and worked. We ended up not going with that route so I decided to live in Canada because I didn't feel comfortable being away from him.

 

I know my son will have to answer Yes to that question, but will they ask for more details about why I'm applying again? I don't even remember if it was the I-130 form I filed 26 years ago, but he did do a medical exam amongst other things.

You do not need details, IMHO.  Knowing which year it was is good.  It was a marriage-based spousal visa that you decided not to pursue at that time, so just explain that.

My son has his CRBA. The I130 Page 3, Question 38. is asking if he has obtained a certificate of naturalization or certificate of citizenship. Will the CRBA be sufficient for this? Or will he have to file N600 prior to sponsoring my husband?

He can use his US passport and yes you would have petitioned him using the I 130

He does not need an N600.

Well most USC's who have Passports do not have one so I assume a non issue.

 

If this has been asked before I do not remember the answer.

I assume that your son is living in the US and that he is 21 or older?
