In my case, filing jointly will make my refund $3,000 less but separately was higher but since he is still conditional resident, have no choice than to file jointly

Filing jointly is not a requirement for I-751. If you have other good evidence, it may be OK to file MFS.

What other good evidences do they accept? We have couple of vehicles with both names. 

We don't have mortgage yet but we have our joint apartment lease. we are starting a business together this year within the next couple of months.
