I am still not certain I understand everything. For instance; have you been convicted of a crime?

But in any case, I am very certain of one thing. YOU HAVE A VERY CARELESS ATTORNEY!

The original application was not completed properly and the response to the request to correct the application was also not done properly. I would never use that attorney again! Not at any price. Not if she paid me. Not if she was my sister. No way, no how.

Because of your prior marriage your situation is complicated. I suggest you find an experienced immigration attorney that speaks your native language to help you. You need to do everything perfectly and you need to start planning now how to answer the objections that will be raised at the embassy. You also need an attorney that has experience appealing decisons and not just submitting applications.

I am sorry for the problems you are having and I wish you better luck in the future.

  1. If you take the refund from the attorney, make sure you receive enough money to cover the variance for the new fees.
  2. If you change lawyers, make sure you receive a written explanation as to why you are now filing another petition.
  3. If both the petitioner and the beneficiary have a language barrier, I urge you to use a competent lawyer as opposed to doing it on your own.

I would also ask the new attorney I you should consider legal action against your previous one.

He/she was clearly incompetent and negligent.

My k1 visa was denied my lawer got RFE on i have i been conveted of any crimes i told her the information and she sent it in with out my signature IT WAS DENIED now i must reaply for new peteion all over again now i think i need a waver i have had a k1 visa in the past 8 years ago the marrage lasted 5 years we devorce i filed my 2 visa and was deied mistake bye my lawer to re file for same fiancee due i need a waver and if so what are the chance it will be aproved or should i appeal the decishone of the denied BIG PROUBLEM hear

Isn't it possible that your fiance can help you with all this paperwork. I guess he is fluent in american language.

If you consider legal action against the attorney, be sure to place legal action on your former grade school for the English they taught you. I'm not trying to belittle you. But it's obvious somehow they slipped you through the system. If you are the US citizen :(

My K-1 visa was denied. My lawyer received an RFE asking if I had been convicted of any crimes. I told her the information and she sent it in without my signature and IT WAS DENIED. Now I must reapply for a new petition all over again. Now I think I need a waiver.

I had a k1 visa 8 years ago. The marriage lasted 5 years, ending in divorce. Do I need a waiver, and if so what are the chances it will be approved? Or should I appeal the decision?

The letter my lawyer received is below. My lawyer did not send me this RFE to put my signature on it, she just asked me to tell her if I had been convicted of a crime. She sent it in without my name on it. I think anyone who sent in a petition should state convicted crimes up front to AVOID RFE!

On the petition you filed on April 2, you failed to complete part C of the form. In a Notice of Action may 18 you were notified you must complete the form. You were then asked to respond to the question in part C and sign and resubmit the form that was sent to you. Your response received by the office May 29 did not include your signature on form you resubmitted. In view of the above the petition is DENIED.

All NEW APPLICATION ALL OVER OR SHE WILL GIVE ME MY MONEY BACK NOT SURE WHAT TO DO YET (??? - confused on this one, but I don't think it's important)

Above are the OP's posts, corrected for grammar and spelling. I'm not trying to belittle you, I'm trying to help and this was the only way I could understand the situation.

It appears that the OP didn't fill out the questions about criminal background, and when his lawyer resubmitted the form, it didn't have his signature on it. That doesn't seem fair for them to deny a petition based on a small oversight.

In any case, get a new lawyer that will be more thorough. I personally would just try to get started ASAP, and worry about returned fees, etc later when this is overwith.

Hi Brad!

I am sorry to hear about your problems...

Maybe this forum will help your fiance to understand more about visa issues

This website in Russian language and there are alot of people who are doing and waiting for K1,K3 visas...

P.S. I heared about RFE. It means when some documents are missing and all what you have to do just send them some documents what they need,like divorce degree,more pictures,singnature,etc...

And your visa can be denie only if you didnt each other more than 2 years,you never met her/him in a person, or some of you still married...

I think better for you to find out what happend...

And if you will need to file the petition again just do that yourself...

All paper work is not that hard to prepare,don't think that lawer could do that better than you will or somehow spped up the process...

It's your choice...
