Timeline

Is there a legal way to claim my step son K2 who does not have a social since USCIS is taking their sweet time. We filed AOS for both my wife and step son June 2023. My wife has her EAD but not green card yet my step son has nothing his application just says its being reviewed by uscis. So we tax season being upon us he does have a social so I was just wondering what options I have if any.

11/21/20: I-129F packet shipped via USPS

11/25/20: I-129F delivered to Dallas Lockbox (Lewisville)

11/27/20: Backdated I-129F "received date"

2/23/21: I-129F fee charged to bank account

2/25/21: Text alert NOA1 Receipt/Case Number

3/3/21 :  Received NOA1 Letter in the mail

Put 9s for his SSN, then amend in the future when he gets one?

Have you also tried applying for SSN for him in person at SSA office?

Yes I tried applying for a social and they told me that they would only give me one after his i-485 or i-765 was approved which we sent both with our AOS packet he did biometrics  back in August but we are still waiting 😕

A K2 can only get a SSN after they receive an EAD or GC.
