hi all first timer here, just wondering how you go about visiting USA when you are apping for the K-1. is it just like any other trip? or do i have to bring a ton of stuff to show them at the boarder? thx for the help ^^

Best of my knowledge you can not enter hte USA once you apply for the K!, K3, I-130 etc.

Some people have said you can try to come in on the (I forget the name .. whenre you don't need a real visa from canada, eaurope and osme other countries) but it is taking a chance, because they may just turn you right around and send you home.

The problem is US law. If you are in the USA and you come in WITHOUT the intent to marry, but fall in love and "happen" to get married then you dont have to leave.

So, if you come in on a tourist visa AFTER you have filed a marriage visa, and the temptation to "accidentally" get married and stay would be very high. So for the most part they wont let you in.

From some countries (China is one.) it is a waist of time and money to attempt to get a visa to begin with. The OP doesn't mention their country of origin. It is critical to getting meaningful answers.

hEY FRIENDS, my situation is a little different,i came on B1/B2 visa, got married, we filed I-130 But due to urgency in my home I had to return to India, after 2 weeks of marriage (sorry). apparently didnot file I-485. I guess we are screwed now. I find no path but to apply for K3 and wait. Anyone can please suggest something, we both feel disturbed now.

So sorry about your situation, the only thing you can do it wait it out on the K3. Even filing AOS doesn't give you the ability to leave the US...only AP can do that. Hope things process smoothly for you.

As pushbrk said, it depends on where you're coming from. Some countries you are required to have a visitor's visa to enter...some do not. You would, from all that I've read here, need to show strong ties to your country at the POE...such as job or letter from employer stating you are expected back at work on a certain date, mortgage or lease, utility bills or bills that are paid on a montly basis, that sort of thing. There are many who visit their fiancé(e) whilst the K1 is being processed.

I am afriad you are not in a good position. Depending on your visitor intent when you entered the U.S. using your B1/B2; you could have applied for I-485 Adjustment of Status.

Since you have left the country, that is all moot - you have the K3 or the IR1/CR1 option. DCF may be available to you if it is offered by your consulate and your U.S. Citizen spouse wants to relocate to your country to live there for 6+ months. (Of course, that makes it harder to show U.S. domecile and sufficient U.S. income above the 25% above poverty line).

Dont even bothered, I am canadian as a canadian we dont need to have a visa to cross the border, Me and my friend was going to buffalo just see the fatima shrine its a catholic church, they stop us at the border take a picture of me fingerfrint and scolded me like a criminal. i was so scared :devil: its not worthy, that incident trumatize me so much, until now im scared with immigration people.

Now they are treating Canadians the same as they treat Mexicans at border crossings.

I'm not certain if there are any rules that give direct CBP (Customs & Border Patrol) to give special treatment to either Mexicans or Canadians.

Assuming there is no such rule, I would expect CBP to give Canadians and Mexicans the same treatment.
